Dear Mr. Lochbaum:

In your letter dated July 10, 2012, you (Ms. Mary Olson, Mr. Jim Warren, and you) requested that the NRC take enforcement action in the form of an order either modifying the Brunswick Units 1 and 2 operating licenses technical specifications (as detailed in the petition) or requiring the licensee to submit amendment requests for these licenses.

The Nuclear Regulatory Commission (NRC) Petition Review Board (PRB) had a recorded conference call with you and Ms.

Olson on August 15, 2012. During this conference call with the PRB, you and Ms. Olson provided additional information to supplement the original petition request dated July 10, 2012 . The official transcript of the August 15, 2012 meeting is accessible via the public web site Electronic Reading Room in the Agency Document Access and Management System (ADAMS), http://www.nrc.gov/reading-rm/adams.html (ADAMS Accession Number ML12234A730)

The PRB discussed your petition, as supplemented on August 15th, and determined that your petition met the criteria for review. Therefore, the PRBs initial recommendation is to accept your petition for review under the 10 CFR 2.206 process. Per MD 8.11, if you have additional information in support of your petition for the PRB to consider, we are offering you another opportunity to address the PRB. Please notify me by September 14, 2012, with your availability, if you wish to address the PRB in a public meeting or via a recorded conference call. If I have not heard from you by September 14th, the PRB's initial recommendation will become the final recommendation and we will proceed with processing your request as recommended by the PRB. Further details regarding the PRB's final recommendation and the NRCs future actions will be provided to you in an acknowledgement letter.
