MID-CYCLE ASSESSMENT LETTER FOR TURKEY POINT NUCLEAR PLANT UNIT 3 AND UNIT 4 (NRC INSPECTION REPORT 05000250/2012006 AND 05000251/2012006)

Dear Mr. Nazar:

On August 15, 2012, the NRC completed its mid-cycle performance review of the Turkey Point Nuclear Plant Unit 1 and Unit 2. The NRC reviewed the most recent quarterly performance indicators in addition to inspection results and enforcement actions from July 1, 2011, through June 30, 2012. This letter informs you of the NRCs assessment of your facility during this period and its plans for future inspections at your facility.

The NRC determined that overall, Turkey Point Unit 3 and Unit 4 operated in a manner that preserved public health and safety and met all cornerstone objectives. The NRC determined the performance at Turkey Point Unit 3 and Unit 4 during the most recent quarter was within the Regulatory Response Column of the NRC=s Reactor Oversight Process (ROP) Action Matrix because of one White Finding in the Emergency Preparedness Cornerstone. This finding was documented in a final significance determination and assessment follow-up letter issued by the NRC on April 9, 2012, as Inspection Report 05000250/20120010 and 05000251/20120010 (ML12100A243). The April 9, 2012, letter documented the performance of Units 3 and 4 to be in the Regulatory Response Column of the Action Matrix as of the fourth quarter of 2011.

Turkey Point Unit 3 and Unit 4 performance remained in the Regulatory Response Column during the first and second quarters of 2012.

On July 31, 2012, your staff notified the NRC of your readiness for a supplemental inspection to review the actions taken to address the performance issues associated with the White finding.

Therefore, in addition to ROP baseline inspections, the NRC plans to conduct a supplemental inspection in accordance with Inspection Procedure 95001, beginning the week of September 10, 2012. This inspection procedure is conducted to provide assurance that the root causes and contributing causes of risk significant performance issues are understood, the extent of condition is identified, and the corrective actions are sufficient to prevent recurrence.

M. Nazar 2 The enclosed inspection plan lists the inspections scheduled through December 31, 2013.

Routine inspections performed by resident inspectors are not included in the inspection plan. In addition to the baseline inspections, consistent with the Agencys actions related to Fukushima, the NRC will perform TI-187, Inspection of Near-Term Task Force Recommendation 2.3 Flooding Walkdowns, and TI-188, Inspection of Near-Term Task Force Recommendation 2.3 Seismic Walkdowns. The inspections listed during the last nine months of the inspection plan are tentative and may be revised at the end-of-cycle performance review. The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. The NRC will contact you as soon as possible to discuss changes to the inspection plan should circumstances warrant any changes. This inspection plan does not include security related inspections, which will be sent via separate, non-publicly available correspondence.

The NRC also plans on conducting Inspection Procedure 71004, Power Uprate, and initial operator licensing examinations.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
