DRESDEN NUCLEAR POWER STATION, UNITS 2 AND 3 - WITHDRAWAL OF REQUESTED LICENSING ACTION RE: REQUEST FOR EXEMPTION FROM 10 CFR 50, APPENDIX R, SECTION III.L (TAC NOS. ME8008 AND ME8009)

Dear Mr. Pacillo:

The U.S. Nuclear Regulatory Commission (NRC, the Commission) has granted the request of Exelon Generation Company (the licensee) to withdraw its February 13, 2012, request for exemption as supplemented by letter dated March 23, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML12045A426, and ML12086A014 respectively), for Facility Operating license Nos. DPR-19 and DPR-25 for the Dresden Nuclear Power Station, Units 2 and 3, located in Morris, IL.

Title 10 of the Code of Federal Regulations, Part 50, Appendix R, "Fire Protection Program for Nuclear Facilities Operating Prior to January 1, 1979,"Section III.L, "Alternative and dedicated shutdown capability," paragraph 4 requires that "the number of operating shift personnel, exclusive of fire brigade members, required to operate such equipment and systems shall be on site at all times." This is in reference to having enough personnel to achieve and maintain hot standby or hot shutdown conditions if fire damage occurs.

The proposed exemption would have exempted the licensee from the requirement for an on shift High Voltage Operator and an on-shift Operations Supervisor to be "on site at all times" during their shift in order to perform their duties at remote site locations. The request for exemption implies that the licensee currently has additional staff onsite specifically for these duties.

As documented in letter dated March 19, 2012 (ADAMS Accession No. ML120600011), the NRC, via teleconference, notified the licensee that supplemental information was required to complete the acceptance review. Specifically, the licensee needed to provide justification that adequate time margin was available to account for uncertainties in estimating time for an operator to return to the plant to perform the manual actions.

The NRC staff review indentified that your supplement dated March 23, 2012, did not provide technical information in sufficient detail to enable the staff to complete its detailed review.

Subsequently, by letter dated April 9, 2012 (ADAMS Accession No. ML12101A012), the licensee asked to withdraw the exemption request
