.Docket Numbers 50-369 and 50-370 License Amendment Request for Temporary Changes to Technical Specifications and Limited Duration Use of NUREG-0800, Section 3.5.1.3, Revision 3, to Allow Nuclear Service Water System (NSWS) 'A' Train Repair By letter of November 9, 2011, Duke Energy Carolinas, LLC (Duke Energy) submitted a license amendment request (ADAMS Accession No ML11318A117) for the Renewed Facility Operating License and Technical Specifications for McGuire Nuclear Station Units 1 and 2 to permit the NSWS 'A' Train to be inoperable up to a total of thirty (30) days to allow for the repair of buried

'A' Train supply piping from the Standby Nuclear Service Water Pond.

During the December 7, 2011 telephone conversation with members of the NRC staff, Duke Energy was informed that approval of the proposed license amendment request would require an evaluation using a Probabilistic Risk Assessment (PRA) seismic external hazard model that had been subject to a peer review addressing the technical characteristics and attributes of seismic PRA as described in Regulatory Guide 1.200, Revision 2, "An Approach for Determining the Technical Adequacy of PRA Results for Risk-Informed Activities."

Regulatory Guide 1.200, Revision 2 describes one acceptable approach for determining whether the technical adequacy of the PRA, in total or the parts that are used to support an application, is sufficient to provide confidence in the results, such that the PRA can be used in regulatory decision-making.

The Duke Energy PRA model does not currently meet the requirements of Regulatory Guide 1.200, Revision 2 in that a peer review has not been performed on the seismic PRA model.

In that Duke Energy is presently unable to provide an evaluation using a seismic PRA meeting Regulatory Guide 1.200, Revision 2, it is requested that the subject license amendment request be withdrawn from further consideration.

There are no regulatory commitments made in this submittal.
