REQUEST FOR EXEMPTIONS FROM CERTAIN REQUIREMENTS IN 10 CFR PART 72 FOR THE SURRY POWER STATION INDEPENDENT SPENT FUEL STORAGE INSTALLATION - SUPPLEMENTAL INFORMATION NEEDED

Dear Mr. Hartz:

By letter dated July 21, 2011, Virginia Electric and Power Company (Dominion) requested exemptions from the requirements of 10 CFR 72.212(b)(3) and (b)(11). The exemptions were requested for NUHOMS HD Dry Shielded Canisters (DSC), Model Number HD-32PTH, with serial numbers DOM-32PTH-001-C, -002-C, -003-C, and -009-C due to non-compliance with the terms and conditions of the Transnuclear, Inc., Certificate of Compliance (CoC) 72-1030, Amendment No. 0. At the time of loading, the decay heat limit was exceeded for five fuel assemblies. The five fuel assemblies are distributed over the four identified DSCs.

U.S. Nuclear Regulatory Commission staff performed an acceptance review of the exemption request, to determine if the request contains sufficient information to allow the staff to complete the detailed technical review. This letter is to advise you that based on our acceptance review, the request does not contain sufficient information. The information needed to continue our review is described in the enclosure to this letter as a Request for Supplemental Information. In order to schedule our technical review, this supplemental information should be provided by September 14, 2011. If the supplemental information is not received by this date, the review of this request may be delayed. The supplemental information requested and associated timeframe for the Dominion response were discussed with Mr. Thomas Szymanski of your staff on August 25, 2011.

The July 21, 2011, exemption request does not include an environmental report. To aid the staff in performing an environmental assessment, an environmental report should be submitted pursuant 10 CFR 51.60 which discusses the considerations of 10 CFR 51.45.

This information is needed for staff to complete an environmental assessment pursuant 10 CFR 51.30.

Thermal Evaluation Provide the ANSYS files required to run the thermal analyses presented in Transnuclear, Inc.

Calculation No. 10494-174, including the files listed in Section 6.0 of the calculation.

The staff needs the files to run the ANSYS thermal analyses, including those listed in Section 6.0, to verify the models presented in Transnuclear, Inc. Calculation No. 10494-174.

This information is needed to determine compliance with 10 CFR 72.122(h).
