SURRY POWER STATION UNIT 1 AND UNIT 2 - ENVIRONMENTAL ASSESSMENT AND FINDING OF NO SIGNIFICANT IMPACT RELATED TO ISSUANCE OF EXEMPTION TO ALLOW CONTINUED STORAGE OF THE NUHOMS HD SYSTEMS LOADED TO THE INCORRECT HEAT LOAD LIMITS (TAC NO. L24552)

Dear Mr. Hartz:

Enclosed is a copy of the Environmental Assessment and Finding of No Significant Impact related to your application for an exemption dated July 21, 2011, as supplemented September 28, 2011, with respect to Transnuclear, Inc. (TN) NUHOMS HD Storage System (HD-32PTH) dry storage casks with serial numbers DOM-32PTH-001-C, -002-C, -003-C, and

-009-C. The proposed action would grant a one-time exemption from the following requirements of Title 10 of the Code of Federal Regulations, in order to allow Virginia Electric and Power Company (Dominion) to store the above four dry spent fuel storage casks (DSC) at Surry Power Station Unit 1 and Unit 2 Independent Spent Fuel Storage Installation.

10 CFR 72.212(b)(3), which states [e]nsure that each cask used by the general licensee conforms to the terms, conditions, and specifications of a CoC or an amended CoC listed in § 72.214.

The 10 CFR 72.212(b)(11) requirement that [t]he licensee shall comply with the terms, conditions, and specifications of the CoC.

The portion of the 10 CFR 72.212(b)(11) requirement that the licensee maintain CoC records continues to apply.
