COMMITMENT TO SUBMIT A LICENSE AMENDMENT REQUEST TO TRANSITION TO 10 CFR 50.48(c), NATIONAL FIRE PROTECTION ASSOCIATION STANDARD NFPA 805, AND REQUEST TO EXTEND ENFORCEMENT DISCRETION - CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2, NINE MILE POINT NUCLEAR STATION, UNIT NO.1, AND RE. GINNA NUCLEAR POWER PLANT - (TAC NOS. ME6624, ME6625, ME6593, AND ME6626)

Dear Ms. Korsnick:

By letter to the Nuclear Regulatory Commission (NRC) dated June 20, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML11179A032),

Constellation Energy Nuclear Group, LLC (CENG) committed to submit license amendment requests (LARs) to transition to National Fire Protection Association Standard NFPA 805 in accordance with Title 10 of the Code of Federal Regulations 50A8(c) for (1) Nine Mile Point Nuclear Station, Unit No.1 by June 29,2012, (2) RE. Ginna Nuclear Power Plant by March 29, 2013, and (3) Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2 by September 30, 2013. In addition, CENG requested that enforcement discretion for fire protection issues be extended to correspond with the LAR submittal dates.

The NRC staff has reviewed your letter and finds it consistent with Commission direction as provided in SRM-SECY-11-0061, dated June 10,2011 (ADAMS ML111610616). Therefore, your request to extend enforcement discretion is granted in accordance with the Interim Enforcement Policy concerning Enforcement Discretion for Certain Fire Protection Issues as published in the Federal Register on July 12, 2011 (76 FR 40777).
