Document Control Desk June 20, 2011 Page 2 In accordance with Reference (a), as approved by the Nuclear Regulatory Commission (NRC) in Reference (b), Calvert Cliffs Nuclear Power Plant, R.E. Ginna Nuclear Power Plant, and Nine Mile Point Nuclear Station will submit license amendment requests (LARs) to implement 10 CFR 50.48(c) on the following schedule:
Nine Mile Point Nuclear Station, Unit 1 - June 29, 2012' R. E. Ginna Nuclear Power Plant - March 29, 2013 Calvert Cliffs Nuclear Power Plant, Units 1 and 2 - September 30, 2013 This is a change to the schedules submitted in References (c) through (e). These dates are regulatory commitments.
In each case, we request that enforcement discretion be extended to correspond to the LAR submittal commitment date. In addition, we request that, once the LAR is submitted, enforcement discretion would continue until the NRC dispositions the LAR to transition to NFPA 805. It is our intention to continue to pursue activities needed to complete the transition while we are preparing the license amendment requests.
It is our understanding that the Staff expects submittal dates by July 1 in each fiscal year. The Calvert Cliffs submittal date is after July 1 in fiscal year 2013. The time is needed because Calvert Cliffs is the most complex of the plants owned by Constellation Energy Nuclear Group. A submittal by July 1, 2013 would require diverting resources from the Ginna submittal, which will be in the preceding March. In our opinion, this is the best schedule that will provide time required to ensure the development of quality evaluations and license amendment requests for Ginna and Calvert Cliffs.
