The petition was submitted pursuant to Title 10 of the Code of Federal Regulations, Section 2.206. The enclosure contains the transcript "from the petitioner's "first opportunity to address the petition review board (PRB) which occurred on June 13, 2011. 1 I'm the Petition Manager for this 1 petition. Peti tion Review Board Chairman is David 1 Skeen. As part of the Petition Review Board's review of this petition, Thomas Saporito has requested the 1 opportunity to address the Board.

Section 2.206 of Title 2 [10J of the Code of Federal Regulations describes 2 peti tion process, which is the primary mechanism NEAL R. 7 1 the public to request enforcement action by the NRC a 2 public process. This ts anyone to petition the 3 NRC to take enforcement type action related to NRC licensees or licensed activities. Depending on the result of this evaluat NRC could modify, suspend or revoke an NRC license or take any other appropriate enforcement action to resolve a problem.

The NRC s f guidance for the dispos of 2.206 petition request can be found in Management 1 Directive 8.11, which publicly available.

1 This teleconference is not a hearing nor is it an opportunity the petitioner to question or 1 examine the Peti on Review Board on the merits or the issues presented in petition request.

9 two SCRAM events which occurred at Limerick Generating 2 Station Unit 2, on May 29th and May 30th, of 3 year. In the petition request, Mr. Saporito requests 4 that the NRC do two things:

(1) Is to escalated enforcement 6 action against Exelon Generating Company and suspend 7 or revoke the NRC licenses granted for operation of the Limerick Generating Station, and; (2) To issue a of violation with a 1 proposed civil penalty against the licensee and Mr.

13 As the basis thi s reques t , Mr.

1 Saporito states that on or about May 30th, 2011, 1 Limerick Generating Station experienced an unexpected 1 shutdown, also called a SCRAM event at Unit 2 where 1 two reactor recirculation pumps tripped off line 1 during reactor start up operations. This significant event lowed a similar signi cant event which 2 occurred less than 36 hours4.166667e-4 days <br />0.01 hours <br />5.952381e-5 weeks <br />1.3698e-5 months <br /> earl on the very same 2 reactor where the nuclear reactor experienced a SCRAM 22 event.

10 to second SCRAM event than 36 hours4.166667e-4 days <br />0.01 hours <br />5.952381e-5 weeks <br />1.3698e-5 months <br /> 2 petitioner is concerned that these unexpected 3 SCRAM events are serious events which challenge ear safety systems designed to protect publ th and safety from exposure to nuclear particles and contamination. Mr Saporito states that the fact the licensee fai to properly analyze, determine and correct the root cause of the initial SCRAM event prior to restarting the nuclear reactor in 1 question significantly undermines any confidence that 1 the NRC can have that the 1 will comply with 12 the agency's safety regulations in the operation of 13 the Limerick Generating Station under 10 CFR [P] art 1 50.

1 Thus the peti tioner [ concerned that 1 the licensee cannot provide NRC wi th any measure of reasonable assurance that will comply with the 1 NRC regulations and requirements under 10 CFR [P] art 50 the operation of the Limerick Generating Station 2 going forward.

2 So now allow me to scuss quickly the NRC 22 activi ties to date. On June 2nd, 2011 the petition 23 manager contacted Mr. Saporito to discuss the 10 CFR 2 2.206 process and to offer an opportunity to address 2 the PRB by phone or in person. 11 to address the PRB by phone prior to its internal 2 meeting to make the initial recommendation as to 3 whether to accept or reject the tion for review.

9 So with that, Mr. Saporito I'll turn it 1 over to you to allow you to provide us wi th any 1 information you believe that we should consider as 12 part of this petition.

13 Mr. Sapori to: Okay. Thank you. Good 1 [a]fternoon to everyone. My name is Thomas Saporito 1 and I am Senior Consulting Associate with []

1 Following significant events at the Exelon et. al., Limerick Nuclear Plant in May of this year, 2 Saprodani Associates represented by, through, and with 2 me collectively the petitioner[,] filed an enforcement 22 petition with the NRC against Exelon and its Chief 23 Executive Officer John Rowe [, ] collectively the 2 licensee seeking escalated enforcement action to be 2 taken by the NRC against the Specifically, NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., NW.

12 because the licensee fai to properly analyze, 2 determine and correct the root cause of one or more 3 SCRAM events, or nuclear reactor trips, prior to restart of the subject nuc reactor, that action significantly undermines any confidence or reasonable assurance that the NRC can have that the censee will 7 comply with the agency's safety regulations under 10 8 CFR [P] art 50 operation of the Limerick Nuclear 9 Plant. Peti tioners assert here that the licensee's 1 actions at the Limerick Nuclear Plant endangered 1 public health and safety from the consequences of a 12 serious nuclear accident s lar to ongoing 13 nuclear disasters currently unfolding in the country 1 of Japan. And that the NRC must take escalated 1 enforcement action against licensee to protect 1 public health and safety in these circumstances.

17 The discussion today serves as a 18 supplement to petition that was filed with the NRC 19 on June 1st of this year. Petitioners' request:

2 (1 ) That the NRC suspend or revoke the 2 NRC licenses issued to the licensee authorizing 22 operation of the Limerick Nuclear Plant, and; 23 (2 ) That the NRC issue a notice of 2 violation with a civil penalty in the amount of 2 $500,000 against the licensee to make certain that the NEAL R. 13 1 licensee zes this very nature of the 2 violation and endangerment to public health and 3 safety. And to insure that reoccurrence of this type of violation is prevented.

Let me speak brief about a 1 6 background about the Limerick Nuclear Plant 7 performance. The licensee has a miserable performance record at Limerick Nuclear Plant over the course of this year alone, not to mention the plant s past I 1 record violating NRC safety regulations in 1 operations of the Limerick Nuclear Plant.

12 On February 25th, 2011, Unit 2 employed a 13 manual nuclear reactor trip from 100 percent power 14 when both 2A and 2B recirculation pumps tripped off line. At time the licensee alleged that the pumps IE trip off line due to main generator stator water coolant runback. However, the licensee informed the NRC that cause of the stator water coolant runback 19 was currently under investigation at the time of 2 occurrence.

2 On April 2nd, 2011, Unit 2 refueling 22 outage activi ties were taking place when an invertor 23 alternate power manual transfer switch was transferred 2 from the primary alternate to secondary alternate 2 position to support post maintenance testing NEAL R. 14 1 activities. This resulted in the primary containment 2 isolation valve automatically closing on more than one 3 system. The apparent root cause appears to be human error since the trans swi tch J.S a break before make, which interrupted the alternate power supply momentari The licensee failed to state to the NRC if any corrective action had been or were planned to be taken to prevent reoccurrence of this event as of the date of occurrence.

1 On May 29th, 2011 Unit 2 nuclear reactor 1 tripped off line due to low pressure in the 12 electrohydraulic control fluid to number 3 turbine 13 control valve following maintenance work activity.

1 The licensee did not state the root cause of this 1 event to the NRC upon occurrence.

1 On May 30th, 2011, Unit 2 was manually tripped off line due to dual recirc pump trip during 1 start up activities. licensee informed the NRC that it was investigating a potential issue with the 2 relay logic associated with the SCRAM bypass feature.

2 However, the licensee led to identify the root 22 cause the event at that time.

23 On June 3rd, 2011, Unit 1 tripped off line 2 from 100 percent power. The licensee informed the NRC 2 that the cause of that main turbine was under NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.w.

15 investigation.

2 This history highlights the seriousness of 3 the events that have occurred during the short period of six months at the Limerick Nuclear Plant. The SCRAM events or an event where the nuclear reactor automatically shuts down or trips off line places a tremendous amount of stress on the entire nuclear reactor system and supporting equipment. This stress can cause failure of one or more systems at any time especially of the reactor vessels.

There's some 104 nuclear reactors 12 operating in the united States of America at this 13 time. And the majority of these nuclear reactors, including the Limerick Nuclear Plant, have been operating close to 40 years or more. Therefore, these plants including the Limerick Nuclear Station are operating at the very end, if not at the end, of their safety design basis for which the NRC initially issued an operating license for 40 years. [A] f ter 40 years of operation the reactor vessel at the Limerick Nuclear Station has become embri ttled to a certain 22 degree from the effects of high level radiation 23 bombardment during the fission process which takes 2 place in the reactor core during normal plant 2 operations on a seven day 24 hour basis. 16 embrittlement subjects the reactor vessel to cracking 2 at any Therefore, the licensee In this 3 particular case, Exelon, must extra careful and make certain that the nuclear reactor operates without automatically SCRAMing or events which cause the operators to manually SCRAM the nuclear reactor do not occur. This is simply not the case at the Limerick Nuclear Station.

Clearly this number nuclear reactor 1 SCRAMs, be it automatic or manual, it should be seen 1 by the NRC as unacceptable performance by the licensee 12 and the NRC should increase its inspection activities 13 in accordance wi th its own reactor oversight process 1 and to insure for the protection of public health and 1 safety.

1 There appears to be well, before I go on to that, let me just state that on June 4th, 2011, 1 [The Pottstown] Mercury newspaper, I believe that's based out of Pennsylvania, issued a news article about 2 the Limerick Nuclear Station. And just the excerpts 2 from this state that "Limerick Unit 1 experienced an 22 automatic SCRAM about 10:15 a.m. today. One day later 23 while completing testing on the system the controls 2 the opening and closing of turbine valves, the turbine 2 tripped line again at 11:50 a.m. Monday. In NEAL R. 17 February the same reactor, Unit 2 shut down 2 unexpectedly due to problems with the systems related 3 to recirculating pump. That shutdown lasted for more than two days."

And if this Mr. Sheehan, S-H-E-E-H-A-N, apparently he'S a representative of the Nuclear Regulatory Commission, was quoted as stating "Our senior resident inspector went to the plant's control room immediately after SCRAM and is independently 1 verifying whether plant operators are lowing the 1 appropriate steps and procedures. We will continue to 12 gather our information on what occurred and the 13 company's response to it. II He is later quoted as 1 saying" Again a plant has to have more than three 1 unplanned SCRAMs during that 7,000 hour period to 1 receive increased NRC oversight." unquote Sheehan wrote.

1 That's unacceptable performance on the part the NRC as far as petitioners are concerned.

2 The public cannot wait for 7,000 hours of poor 2 performance in having more unplanned reactor SCRAMs 22 and fer the consequences of a nuclear accident 23 where radiation 1S released from that plant and 2 endangers the heal th and safety of the publ The 2 NRC should be more on top of their game and they NEAL R. 18 should immediately ordered the suspension of that 2 license and prevented any restart the reactor until 3 the licensee could definitely and affirmatively identify and correct the root cause of those reactor trips that where commented in that news article.

tioner[s] further that there is a 7 lack of training on system functionality and repair activities on part of the licensee at the Limerick Nuclear Station. For these equipment problems to have 1 occurred without any determination of a root cause and 1 without any apparent determination of corrective 12 action l these reactor trips are repeating themselves.

13 So when this equipment is taken down during 1 [re]fueling outages for maintenance and repairs I which 1 are a normal course of activities during refueling 1 outages I apparently the repair activities weren't performed correctly or the 1 personnel 1 performing the weren't properly trained to 1 make the repairs and/ or [per]form proper post-2 maintenance testing to insure reliabil of the 2 equipment which maintenance activities occur to.

2 There appears to be a lack of supervisory oversight during repair activi ty at the 2 Limerick Nuclear Station where apparently management 2 were not doing job to oversee maintenance NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.w.

19 ties of the nuclear workers at that Limerick 2 Nuclear plant when they do repair activities at the 3 plant, when they do post-maintenance activity on the r activities at the plant, and when they do surveillance testing.

This equipment that was identified by the 7 licensee to the NRC as being in connection with one or 8 more of these reactor trips is subject to surveillance 9 testing. Periodic testing by the 1 to ensure 1 that the equipment calibrated, to ensure that the 1 equipment is operating per technical specifications 12 and within the parameters of the equipment 13 manufacturer. Apparently this surveillance testing and these maintenance activities aren't being performed adequately. Otherwise these systems would not be failing and causing the nuclear reactor to trip off line.

Most concerning to the petitioners is the lure on the part of the licensee to affirmatively determine the root cause of the nuclear reactor trip prior to restart of the nuclear reactor. In 22 connection with that concern, petitioners are also 23 very concerned about the NRC's performance having NRC 2 resident inspectors on site at the Limerick Nuclear 2 Station in allowing the licensee to restart a nuclear NEAL R. 20 reactor after nuclear reactor has been 2 automatically tripped or SCRAMed, or manual tripped 3 or SCRAMed off line. So here represents a danger to the public health and safety. Because if the root cause not properly determined, analyzed and resolved whether root cause is mechanical, electrical, pneumatic or human performance there could be no reassurance on the part of the licensee to the NRC that they will comply with NRC requirements and safety parameters and standards set out under 10 CFR part 50.

What the public and United States does not want to occur in our country and especially at the Limerick Nuclear Plant a repeat of the ongoing meltdown of the nuclear reactor cores that are occurring in Japan; that three separate nuclear reactors and possibly a fourth where radiation would be high level and low level radiation 1S being expelled from that nuclear plant in the form of plutonium, cesium, cobalt-60, iodine-131, contaminated the air, it has contaminated the land where farmers 22 grow crops, it's contaminated the sea. Nuclear fleas, 23 or tiny bits of endangering radioactive particulates 2 have even been traced to the coastline in the United 2 States in California, So if we have an event occur NEAL R. 21 here in the Untied States like that, are the 2 million people going to evacuate to? You know, 3 evacuation is not realistic in any nuclear plant in the United States.

The public depends on Nuclear Regulatory Commission to protect our health and 7 safety. And there's been numerous reports by the 8 Inspector General's Office and by independent public 9 watchdogs 1 the Union Concerned Scientists, 1 which clearly demonstrate the NRC is complacent in its 1 duties and obligations and congressional mandates to 12 protect public health and safety with respect to 13 commercial nuclear plant operations in United States. Here at the Limerick Nuclear Plant it's evident that the NRC 1S complacent where Exelon is allowed to restart nuclear reactors at the Limerick Nuclear Power Plant which have automatically tripped or which were manually tripped off line without first affirmatively and definitively identifying and correcting the root cause of why that reactor was SCRAMed.
