WITHDRAWAL OF A ONE-TIME EXEMPTION FROM PORTIONS OF THE REQUIREMENTS OF 10 CFR 26.205(d)(3) (TAC NO. ME4268)
Dear Mr. Franke:
By letter dated July 13, 2010, as supplemented by letters dated August 26 and September 23, 2010, and March 3, 2011, Florida Power Corporation (the licensee) submitted a request for a one-time exemption from portions of the requirements of Title 10 of Code of Federal Regulations (10 CFR) 26.205(d)(3) for Crystal River, Unit 3 (CR-3). The requested exemption pertaining to 10 CFR Part 26 requirements would have been applied during the restart of CR-3 from its current extended refueling outage.
However, restart of CR-3 has been delayed and subsequently, the licensee determined that the 10 CFR Part 26 exemption was not needed. By letter dated April 11, 2011, the licensee withdrew the exemption request. In its letter, the licensee also stated that a new 10 CFR Part 26 exemption request will be submitted at a later date, if needed.
This letter confirms that the Nuclear Regulatory Commission is treating the above-cited exemption request as withdrawn. If you have any questions, please contact me at (301) 4151447.
