ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission of escalated enforcement actions that will be issued in a Notice of Violation associated with two White Significance Determination Process findings on or around January 31, 2010, to Carolina Power and Light Company (Licensee) as a result of inspections at H.B. Robinson Steam Electric Plant, Unit 2.

The first White finding, an issue with low to moderate safety significance associated with violations, involved the failure to adequately implement requirements, as required by Technical Specifications 5.8.1, Procedures, of multiple procedures during an uncontrolled cooldown of the Reactor Coolant System (RCS) and subsequent safety injection after a reactor trip on March 28, 2010. The safety injection occurred because operators failed to take required procedural actions to stop the uncontrolled cooldown. A second example involved failure by operators to identify a loss of component cooling water flow to the thermal barrier heat exchangers coincident with a failure to identify a loss of charging pump suction that resulted in inadequate seal injection flow. A third example involved the re-energizing of electrically faulted equipment that damaged surrounding equipment and resulted in electrical ground alarms, which required an Alert emergency declaration.

The second White finding, also an issue of low to moderate safety significance, which also included a violation, involved the failure to adequately design and implement operator training based on learning objectives as required by 10 CFR 55.59(c)4. Specifically, training lesson material failed to identify the basis of a procedural action involving reactor coolant pump seal cooling, as required by a systems approach to training, as defined in 10 CFR 55.4. This finding also included examples, deemed not to be violations of regulatory requirements, in which the licensees operator training program did not meet a self-imposed licensee standard.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
