The U.S. Nuclear Regulatory Commission has issued the enclosed Amendment No. 241 to Renewed Facility Operating License No. DPR-20 for the Palisades Nuclear Plant. The amendment consists of changes to the Technical Specifications in response to your application dated January 27, 2010.
The amendment revises Section 2.E. of the Palisades Nuclear Plant (PNP) Renewed Facility Operating License to remove the name of the former operator of the plant in the title of the PNP physical security plan and replace it with Entergy Nuclear. The change also removes the security plan revision number and the date the plan was submitted to the Nuclear Regulatory Commission.
A copy of our related safety evaluation is also enclosed. The Notice of Issuance will be included in the Commission's biweekly Federal Register notice.

The U.S. Nuclear Regulatory Commission (the Commission) has found that:
A.
The application for amendment by Entergy Nuclear Operations, Inc. (the licensee),
dated January 27,2010, complies with the standards and requirements ofthe Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B.
The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C.
There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public; and (ii) that such activities will be conducted in compliance with the Commission's regulations; D.
The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; E.
The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to the license amendment and Paragraph 2.C. (2) of Renewed Facility Operating License No. DPR-20 is hereby amended to read as follows:
The Technical Specifications contained in Appendix A, as revised through Amendment No. 241, and the Environmental Protection Plan contained in Appendix B are hereby incorporated in the license. Entergy Nuclear Operations shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

This license amendment is effective as of the date of issuance and shall be implemented within 60 days.

Pursuant to Section 104b of the Act, as amended, and 10 CFR Part 50, "Licensing of Production and Utilization Facilities," (a) ENP to possess and use, and (b) END to possess, use and operate, the facility as a utilization facility at the designated location in Van Buren County, Michigan, in accordance with the procedures and limitation set forth in this license; (2)
END, pursuant to the Act and 10 CFR Parts 40 and 70, to receive, possess, and use source and special nuclear material as reactor fuel, in accordance with the limitations for storage and amounts required for reactor operation, as described in the Updated Final Safety Analysis Report, as supplemented and amended; (3)
END, pursuant to the Act and 10 CFR Parts 30, 40, and 70, to receive, possess, and use byproduct, source, and special nuclear material as sealed sources for reactor startup, reactor instrumentation, radiation monitoring equipment calibration, and fission detectors in amounts as required; (4)
END, pursuant to the Act and 10 CFR Parts 30, 40, and 70, to receive, possess, and use in amounts as required any byproduct, source, or special nuclear material for sample analysis or instrument calibration, or associated with radioactive apparatus or components; and (5)
END, pursuant to the Act and 10 CFR Parts 30, 40, and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operations of the facility.
C. This renewed operating license shall be deemed to contain and is subject to the conditions specified in the Commission's regulations in 10 CFR Chapter I and is subject to all applicable provisions of the Act; to the rules, regulations, and orders of the Commission now or hereafter in effect; and is subject to the additional conditions specified or incorporated below:

END is authorized to operate the facility at steady-state reactor core power levels not in excess of 2565.4 Megawatts thermal (1 00 percent rated power) in accordance with the conditions specified herein.
(2)
The Technical Specifications contained in Appendix A, as revised through Amendment No. 241, and the Environmental Protection Plan contained in Appendix B are hereby incorporated in the license. END shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.
(3)
END shall implement and maintain in effect all provisions of the approved fire protection program as described in the Final Safety Analysis Report for the facility and as approved in the SERs dated 09/01/78,03/19/80,02/10/81, 05/26/83,07/12/85, 01/29/86, 12/03/87, and 05/19/89 and subject to the following provisions:

The facility has been granted certain exemptions from the requirements of Section III, G of Appendix R to 10 CFR Part 50, "Fire Protection Program for Nuclear Power Facilities Operating Prior to January 1, 1979." This section relates to fire protection features for ensuring the systems and associated circuits used to achieve and maintain safe shutdown are free of fire damage. These exemptions were granted in letters dated February 8, 1983, July 12, 1985, and July 23, 1985.
In addition, the facility has been granted certain exemptions from Appendix J to 10 CFR Part 50, "Primary Reactor Containment Leakage Testing for Water Cooled Power Reactors." This section contains leakage test requirements, schedules and acceptance criteria for tests of the leak-tight integrity of the primary reactor containment and systems and components which penetrate the containment. These exemptions were granted in a letter dated December 6, 1989.
These exemptions granted pursuant to 10 CFR 50.12, are authorized by law, will not present an undue risk to the public health and safety, and are consistent with the common defense and security. With these exemptions, the facility will operate, to the extent authorized herein, in conformity with the application, as amended, the provisions of the Act, and the rules and regulations of the Commission.
E.
ENO shall fully implement and maintain in effect all provisions of the Commission-approved physical security, training and qualification, and safeguards contingency plans including amendments made pursuant to provisions of the Miscellaneous Amendments and Search Requirements revisions to 10 CFR 73.55 (51 FR 27817 and 27822) and to the authority of 10 CFR 50.90 and 10 CFR 50.54(p).
The combined set of plans, which contains Safeguards Information protected under 10 CFR 73.21, is entitled: "Entergy Nuclear Palisades Nuclear Plant Physical Security Plan."

G. ENP and ENO shall have and maintain financial protection of such type and in such amounts as the Commission shall require in accordance with Section 170 of the Atomic Energy Act of 1954, as amended, to cover public liability claims.

1.0 INTRODUCTION
By application dated January 27, 2010 (Agencywide Documents Access and Management System (ADAMS) Accession No. NIL100280114), the Entergy Nuclear Operations,lnc., (the licensee), requested changes to the Technical Specifications (TSs) for the Palisades Nuclear Plant (PNP). The proposed change revises Section 2.E. of the PNP Renewed Facility Operating License to remove the name of the former operator of the plant in the title of the PNP physical security plan and replace it with Entergy Nuclear. The change also removes the security plan revision number and the date the plan was submitted to the Nuclear Regulatory Commission (NRC).
On April 11,2007 (ADAMS Accession No. ML071010308), the purchase of PNP was completed by Entergy Nuclear Palisades, LLC and Entergy Nuclear Operations (ENO) became the plant operator. Thereafter, "Nuclear Management Company" was removed from the title of the physical security plan and replaced with "Entergy Nuclear."
Following the license transfer, there were subsequent revisions to the PNP physical security plan, which were submitted to the NRC. ENO documented in each of the revision submittals that the changes did not decrease the safeguards effectiveness of the PNP physical security plan. All of the revisions were submitted as safeguards information to be withheld from public disclosure in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 73.22.
The change to the name of the PNP physical security plan and submittal of the subsequent plan revisions were not recognized by the licensee, until recently, as having affected Section 2.E. of the Renewed Facility Operating License. The licensee documented this discrepancy in their corrective action system and requested the subject license amendment request (LAR) to make this administrative change.

2.0 REGULATORY EVALUATION
The proposed changes to the Renewed Operating License for PNP was submitted to the NRC pursuant to 10 CFR, Part 50, Section 50.90. The amendment is submitted for the purpose of changing the affected license documents to remove the name of former operator of the change to plant in the title of the PNP physical security plan and replace it with Entergy Nuclear. The change also removes the security plan revision number and the date the plan was submitted to the NRC.
The proposed changes are administrative in nature and involve only a name change and correction of a typographical error. The corporate existence continues uninterrupted, all legal characteristics remain the same and no transfer within the scope of 10 CFR 50.80 will occur with the proposed name change.
The proposed change continues to meet the applicable regulations and requirements and does not require relief from any other regulatory requirements and does not affect conformance with the General Design Criteria as described in the Final Safety Analysis Report.
3.0 TECHNICAL EVALUATION
Following the purchase of PNP, "Nuclear Management Company" was removed from the title of the physical security plan and replaced with "Entergy Nuclear." Following the license transfer, there were subsequent revisions to the PNP physical security plan, which were submitted to the NRC. ENO documented in each of the revision submittals that the changes did not decrease the safeguards effectiveness of the PNP physical security plan. All of the revisions were submitted as safeguards information to be withheld from public disclosure in accordance with 10 CFR 73.22.
However, the change to the name of the PNP physical security plan and submittal of the subsequent plan revisions were not recognized by the licensee, until recently, as having affected Section 2.E. of the Renewed Facility Operating License. The title, revision number, and submittal date of the PNP physical security plan as referenced in Section 2. E. of the Renewed Facility Operating License are not current.
The proposed change revises Section 2.E. of the PNP Renewed Facility Operating License to remove the name of the former operator of the plant in the title of the PNP physical security plan and replace it with "Entergy Nuclear." The change also removes the security plan revision number and the date the plan was submitted to the NRC.
Removing the physical security plan revision number and date of the submittal of the plan revision to the NRC, would also remove an unnecessary administrative burden for ENO and the NRC. This is demonstrated by the four revisions to the plan that were submitted in 2009. The proposed changes will align the Renewed Facility Operating License with the current PNP physical security plan.
These changes do not affect the current design and licensing bases and the operation of the plant, and also there is no physical change being proposed to the structures and components of
- 3 the plant. Based on the above, the NRC staff finds the proposed changes administrative in nature and that it will not affect in any way the safe operation of PNP. Therefore, the NRC staff finds the proposed changes to the license acceptable.
4.0 STATE CONSULTATION
In accordance with the Commission's regulations, the Michigan State official was notified of the proposed issuance of the amendment. The Michigan State official had no comments.
5.0 ENVIRONMENTAL CONSIDERATION
The amendment changes a requirement with respect to the installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20 or change the surveillance requirements. The staff has determined that the amendment involves no significant increase in the amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration and there has been no public comment on such finding (75 FR 70708 and 76 FR 4389). Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9). Additionally, because the amendment changes the licensee's name and makes other editorial changes, it meets the requirements for a categorical exclusion under 10 C.F.R. 51.22(c)(10)(iii) and (v) as well. Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.
6.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
