The Commission has issued the enclosed Amendment No. 169 to Facility Operating License No. NPF-47 for the River Bend Station, Unit 1 (RBS). The amendment consists of changes to the RBS Emergency Plan in response to your application dated January 28, 2010.
The amendment revises Section 13.3.4.2.2.4, "Plant Systems Engineering, Repair, and Corrective Actions," and Table 13.3-17, "Shift Staffing and Augmentation Capabilities," of the Emergency Plan. The revision will allow two maintenance positions on shift to be filled with any combination of the three maintenance craft disciplines. Currently, Table 13.3-17 of the Emergency Plan only allows electrical or instrumentation and control technicians to fill these two positions.
A copy of our related Safety Evaluation is enclosed. The Notice of Issuance will be included in the Commission's next biweekly Federal Register notice.

The Nuclear Regulatory Commission (the Commission) has found that:
A.
The application for amendment by Entergy Operations, Inc. (the licensee), dated January 28, 2010, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B.
The facility will operate in conformity with the application, as amended, the provisions of the Act, and the rules and regulations of the Commission; C.
There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations; D.
The issuance of this license amendment will not be inimical to the common defense and security or to the health and safety of the public; and E.
The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and Paragraph 2.C.(2) of Facility Operating License No. NPF-47 is hereby amended to read as follows:

Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 169 and the Environmental Protection Plan contained in Appendix B, are hereby incorporated in the license. EOI shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.
Further, the license is amended to authorize revision of the current licensing basis for River Bend Station, Unit 1, as set forth in the application for amendment by the licensee, dated January 28, 2010. The licensee shall revise the River Bend Station Emergency Plan Section 13.3.4.2.2.4, "Plant Systems Engineering, Repair, and Corrective Actions,"
and Table 13.3-17, "Shift Staffing and Augmentation Capabilities." The revision will allow two maintenance positions on shift to be filled with any combination of the three maintenance craft disciplines. The changes to the Emergency Plan shall be as set forth in Attachment 3 of the licensee's application dated January 28, 2010.

The license amendment is effective as of its date of issuance and shall be implemented within 90 days from the date of issuance.

Maximum Power Level EOI is authorized to operate the facility at reactor core power levels not in excess of 3091 megawatts thermal (100% rated power) in accordance with the conditions specified herein. The items identified in Attachment 1 to this license shall be completed as specified. Attachment 1 is hereby incorporated into this license.

Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 169 and the Environmental Protection Plan contained in Appendix 8, are hereby incorporated in the license. EOI shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

1.0 INTRODUCTION
By application dated January 28, 2010 (Reference 1), Entergy Operations, Inc. (the licensee),
requested changes to the Emergency Plan (E-Plan) for the River Bend Station, Unit 1 (RBS).
The proposed changes would revise Section 13.3.4.2.2.4, "Plant Systems Engineering, Repair, and Corrective Actions," and Table 13.3-17, "Shift Staffing and Augmentation Capabilities," of the E-Plan. The revision will allow two maintenance positions on shift to be filled with any combination of the three maintenance craft disciplines. Currently, Table 13.3-17 of the E-Plan only allows electrical or instrumentation and control (I&C) technicians to fill these two positions.
The proposed change will reduce the burden related to scheduling of only selected maintenance technicians on shift.
2.0 REGULATORY EVALUATION
Title 10 of the Code of Federal Regulations (10 CFR) Section 50.54(q) establishes that all holders of a nuclear power reactor operating license must follow and maintain in effect emergency plans which meet the standards in Section 50.47(b) and the requirements in 10 CFR Part 50, Appendix E, "Emergency Planning and Preparedness for Production and Utilization Facilities." The regulations in 10 CFR 50.47, "Emergency plans," set forth emergency plan requirements for nuclear power plant facilities.
In 10 CFR 50.47(b)(1), the regulations state, in part, that: "... each principal response organization has staff to respond and to augment its initial response on a continuous basis."
In 10 CFR 50.47(b)(2), the regulations state, in part, that: "... adequate staffing to provide initial facility accident response in key functional areas is maintained at all times," and that "timely augmentation of response capabilities is available...."
- 2 In 10 CFR 50, Appendix E, Section IV, Part A, "Organization," the regulations state, in part, that:
"The organization for coping with radiological emergencies shall be described, including definition of authorities, responsibilities, and duties of individuals assigned to the licensee's emergency organization.... "
Nuclear Regulatory Commission (NRC) Regulatory Guide (RG) 1.101, "Emergency Response Planning and Preparedness for Nuclear Power Reactors," provides guidance on methods acceptable to the NRC staff for implementing specific parts of the NRC's regulations - in this case, 10 CFR 50.47(b) and Appendix E to 10 CFR Part 50. Revision 2 of RG 1.101 (Reference 2) endorses Revision 1 to NUREG-0654/FEMA-REP-1, "Criteria for Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants" (NUREG-0654) (Reference 3), which provides specific acceptance criteria for complying with the standards set forth in 10 CFR 50.47. These criteria provide a basis for NRC licensees, and State and local governments to develop acceptable radiological emergency plans and improve emergency preparedness.
In NUREG-0654,Section II, "Planning Standards and Evaluation Criteria," Evaluation Criteria II.B.1 and II.B.5 address the 10 CFR 50.47(b)(2) planning standard. Evaluation Criteria II.B.1 specifies the onsite emergency organization of plant staff personnel for all shifts and its relation to the responsibilities and duties of the normal shift complement. Evaluation Criteria II.B.5, states, in part, that:
Each licensee shall specify the positions or title and major tasks to be performed by the persons to be assigned to the functional areas of emergency activity. For emergency situations, specific assignments shall be made for all shifts and for plant staff members, both onsite and away from the site. These assignments shall cover the emergency functions in Table B-1 entitled, "Minimum Staffing Requirements for Nuclear Power Plant Emergencies." The minimum on-shift staffing levels shall be as indicated in Table B-1. The licensee must be able to augment on-shift capabilities within a short period after declaration of an emergency. This capability shall be as indicated in Table B-1.
Regulatory Issue Summary 2005-02, "Clarifying the Process for Making Emergency Plan Changes" (Reference 4), was issued by the NRC to clarify the meaning of "decrease in effectiveness" and the process for making changes to emergency plans, and to provide some examples of changes that are considered to be a decrease in effectiveness.
3.0 TECHNICAL EVALUATION
The NRC staff's technical evaluation of the proposed E-Plan changes, as described in the application dated January 28, 2010, is detailed below.
3.1 Allow Two Maintenance Positions on Shift to be Filled with any Combination of the Three Maintenance Craft Disciplines In accordance with Table B-1 of NUREG-0654/FEMA-REP-1, on-shift staffing for the major task of Repair and Corrective Actions should consist of two positions (who per footnote "**,, may be provided by shift personnel assigned other functions). One position title is a mechanical
- 3 maintenance/radwaste operator and the other position title is an electrical maintenance/I&C technician. The current E-Plan requires three personnel on shift to perform Repair and Corrective Action functions associated with mechanical, electrical, and I&C tasks. In its letter dated January 28, 2010, the licensee states that the current practice is to fill these positions with a radwaste operator and two I&C technicians. These personnel are on shift to perform the function of Repair and Corrective Actions associated with mechanical, electrical, and I&C related tasks during the first 90 minutes of an event. The current shift staffing practice does not include mechanical or electrical maintenance technicians on shift.
The licensee's proposal designates the Emergency Response Organization (ERO) function of Repair and Corrective Actions, currently performed by I&C or electrical maintenance personnel, to be performed by electrical, I&C, or mechanical maintenance. As changed, the required shift complement of two technicians may be any combination from the three maintenance discipline groups. The radwaste operator will remain under the Repair and Corrective Action functional area as the mechanical maintenance/radwaste operator on-shift.
The licensee's proposed change will allow the required shift complement of two technicians to be any combination from the three maintenance groups. Since-the Repair and Corrective Action function is currently filled by I&C technicians, additional actions will be taken to ensure basic electrical and I&C tasks can be performed by mechanical maintenance personnel. The licensee states that mechanical maintenance personnel will receive training in basic electrical and I&C tasks to ensure that tasks related to these disciplines can be performed if needed in the first 90 minutes of an event.
The licensee states that during the initial stages of an event, the major response activities are concentrated on determining the cause of the event and placing the plant in a safe condition through plant manipulations and system alignments. Major equipment repairs are not expected to be performed in the initial phases of the event. The Repair and Corrective Action functions that will be performed will be focused on those necessary to implement Emergency Operating Procedures (EOP). These specific emergency tasks are proceduralized in EOP-0005, "Emergency Operating and Severe Accident Procedures Enclosures," and are performed by non-licensed and licensed operators. Using EOP-0005, the licensee identified the following areas where maintenance can be used to assist operators:
Electrical theory Electrical safety for electrical workers Cardiopulmonary Resuscitation (CPR)
Remove/replace fuses Trip units (dial up)
Install/remove electrical jumpers Open/close breakers Operating relays Gagging valves Venting control rods The licensee states that a task analysis will be conducted and training plans developed for mechanical maintenance personnel. Training of Repair and Corrective Action tasks will be conducted prior to using mechanical maintenance personnel to fill this position. Significant,
- 4 ERO-resource intensive Repair and Corrective Action activities are not performed until Emergency Response Facilities are operational and staffed with augmenting personnel as described in Table 13.3-17 of the E-Plan.
This proposed change provides greater initial coverage than the Table B-1 requirement and continues to provide maintenance support capability in the early stages of an event. Based on the on-shift staffing complement designated in the proposed E-Plan change for Repair and Corrective Actions (which is in excess of Table B-1 of NUREG-0654/FEME-REP-1) and the training that will be provided to the mechanical maintenance personnel in basic electrical and I&C tasks, the NRC staff believes that adequate on-shift resources exist to support Repair and Corrective Actions within 90 minutes of an event, prior to being relieved by the augmenting ERO.
The NRC staff concludes that the proposed changes to the function of Repair and Corrective Actions, currently performed by I&C or electrical maintenance personnel, to be performed by electrical, I&C, or mechanical maintenance continues to meet the intent of the NRC-approved E-Plan, and continues to meet the standards of 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.
3.2 Increase the Number of Augmenting I&C Maintenance Personnel Responding Within 90 Minutes from One to Two NUREG-0654/FEMA-REP-1, Table B-1 guidance for Repair and Corrective Actions states that two individuals, one with mechanical maintenance/radwaste operator experience and one with electrical maintenance/I&C experience, should be designated on-shift, but may be provided by shift personnel assigned to other functions. In addition, Table B-1 guidance outlines the addition of one electrical maintenance staff and one I&C staff to be augmented within 30 minutes, and one mechanical maintenance staff, one radwaste operator, and one electrical maintenance staff to be augmented within 90 minutes.
In its submittal, the licensee states that the proposed change adds an additional I&C technician responding within 90 minutes. The result of the proposed change is six additional maintenance personnel, two from each discipline, responding within 90 minutes.
The proposed changes to the on-shift and 90-minute augmented I&C maintenance staffing result in a total of nine personnel designated for Repair and Corrective Actions which is in excess of NUREG-0654/FEMA-REP-1, Table B-1's minimum staffing guidance. This will increase the licensee's capability to perform the Repair and Corrective Actions during an event.
Based on the preceding analysis, the NRC staff concludes the increase in staffing described above to be acceptable. Therefore, the proposed change to staffing to add an additional I&C technician responding within 90 minutes continues to meet the intent of the NRC-approved E-Plan, and continues to meet the standards of 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50
- 5 3.3 Conclusions Regarding Proposed E-Plan Changes Based on the above, the NRC staff concludes that the proposed E-Plan changes meet the standards in 10 CFR 50.47(b) and the requirements in Appendix E to 10 CFR Part 50, and provide reasonable assurance that adequate protective measures can and will be taken in the event of a radiological emergency. Therefore, the NRC staff approves the licensee's proposed changes to the RBS E-Plan.
4.0 REGULATORY COMMITMENTS In support of the proposed application, in its letter dated January 28,2010, the licensee provided the following regulatory commitments:

Additional actions will be taken to ensure basic Electrical/I&C tasks can be performed by Mechanical Maintenance personnel. Mechanical Maintenance personnel will receive training in basic electrical and I&C tasks to ensure that tasks related to these disciplines can be performed if needed in the first 90 minutes of an event.
- 2.
A task analysis will be conducted and training plans developed.
- 3.
Each Maintenance discipline will be appropriately trained to fulfill the required function.
The licensee committed to complete Commitments 1 and 3 on a continuous basis as new individuals are placed on shift. Commitment 2 will be completed as a one-time action upon the implementation of the amendment. The NRC concludes that these commitments are acceptable.
5.0 STATE CONSULTATION
In accordance with the Commission's regulations, the Louisiana State official was notified of the proposed issuance of the amendment. The State official had no comments.
6.0 ENVIRONMENTAL CONSIDERATION
Pursuant to 10 CFR 51.21,51.32, and 51.35, an environmental assessment and finding of no significant impact was published in the Federal Register on October 4,2010 (75 FR 61219).
Accordingly, based upon the environmental assessment, the Commission has determined that issuance of this amendment will not have a significant effect on the quality of the human environment.
7.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the
- 6 Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
