Dear Mr. Pacilio:
This is to acknowledge receipt of Exelon Generation Company, LLC (EGC) letter dated July 23, 2010 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML102070168 (non-public>>, "Exelon Generation Company, LLC - Re-Submittal of the Exelon Cyber Security Plan," which superseded in its entirety the Cyber Security Plan dated November 23,2009 (ADAMS Accession No. ML093280234 (non-public>> based on Nuclear Energy Institute (NEI) 08-09, Revision 3. The Cyber Security Plan by letter dated June 23, 2010, is based on NEI 08-09, Revision 6 which the U.S. Nuclear Regulatory Commission (NRC) staff stated, in its letter dated May 5,2010 (ADAMS Accession No. ML101190371), would be acceptable for use by licensees to comply with the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 73.54 with the exception of the definition of "cyber attack."
Due to the re-submittal of the EGC Cyber Security Plan, the Technical Assignment Control (TAC) numbers associated with the prior NEI 08-09, Revision 3 Cyber Security Plan review have been closed. T AC numbers referenced in the subject line will cover the review associated with the Cyber Security Plan based on NEI 08-09, Revision 6.
As stated in letter dated June 4, 2010, "the NRC staff has decided to forgo the traditional acceptance review due to the complexity and 'first-of-a-kind' nature of this application. While the NRC staff has docketed your application, we are not rendering a judgment as to the acceptability of the submittal within the context of an acceptance review." EGC will be advised of any further information needed to support the NRC staff's detailed technical review by separate correspondence.
