INDIAN POINT NUCLEAR GENERATING UNIT NOS. 2 AND 3 - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NOS. ME2734 AND ME2735)

Dear Sir or Madam:

By letter dated November 17, 2009, Agencywide Documents Access and Management System (ADAMS) Accession No. ML093290044, you applied for an amendment to the Indian Point Nuclear Generating Unit Nos. 2 and 3, Facility Operating License Nos. DPR-26 and DPR-64.

The proposed change would have modified the facility Technical Specifications pertaining to the air start system for the emergency diesel generators. Subsequently, by letter dated August 5, 2010, ADAMS Accession No. ML102250211, you withdrew the amendment request.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

DOCKET NOS. 50-247 AND 50-286 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of Entergy Nuclear Operations, Inc. (the licensee) to withdraw its November 17, 2009, application for proposed amendment to Facility Operating License Nos. DPR-26 and DPR-64 for the Indian Point Nuclear Generating Unit Nos. 2 and 3, located in Westchester County, New York.

The proposed amendment would have revised the Technical Specifications pertaining to the air start system for the emergency diesel generators.

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on January 26,2010 (75 FR 4116).

However, by letter dated August 5, 2010, the licensee withdrew the proposed change.

For further details with respect to this action, see the application for amendment dated November 17, 2009, and the licensee's letter dated August 5, 2010, which withdrew the application for license amendment. Documents may be examined, and/or copied for a fee, at the NRC's Public Document Room (PDR), located at One White Flint North, Public File Area 01 F21, 11555 Rockville Pike (first floor), Rockville, Maryland.
