UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555*0001 August 17, 2010 Mr. Dave Baxter Vice President, Oconee Site Duke Energy Carolinas, LLC 7800 Rochester Highway Seneca, SC 29672 SUB~IECT:
OCONEE NUCLEAR STATION, UNITS 1,2, AND 3, RELIEF REQUEST 09-0N-006 (TAC NOS. ME2344, ME2345, AND ME2346)
Dear Mr. Baxter:
By letter dated September 24,2009, Duke Energy Carolinas, LLC (the licensee) requested approval of relief pursuant to Title 10 of the Code of Federal Regulations, Part 50, Section 50.55a(a)(3)(ii), from the requirements of the American Society of Mechanical Engineers, Boiler and Pressure Vessel Code (the Code), to perform a repair of the standby shutdown facility (SSF) auxiliary service water buried piping which would not meet Code requirements.
By letter dated November 25, 2009, the licensee informed the Nuclear Regulatory Commission (NRC) that the SSF buried auxiliary service water piping was replaced (a Code compliant repair) and the SFF buried piping was returned to service.
The NRC staff finds that the relief is no longer required. This completes the NRC actions under TAC Nos. ME2344, ME2345 and ME2346.
If you have any questions, please call me at 301-415-1345.
Sincerely,
-fvo" n Stang, Senior Project Manager Plant Licensing Branch 11-1 Division of Operating Reactor Licensing Office of Nuclear Reactor Regulation Docket Nos. 50-269, 50-270, and 50-287 cc: Distribution via Listserv
