WADS BAR NUCLEAR PLANT, UNITS 1 AND 2 - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE REGARDING WADS BAR NUCLEAR PLANT CYBER SECURITY PLAN AND CYBER SECURITY PLAN IMPLEMENTATION SCHEDULE (TAC NOS. ME2677 AND ME2679)

Dear Mr. Krich:

By letter dated November 23, 2009 (Agencywide Document and Management System Accession No. ML093290051), as supplemented on December 18, 2009 (ML093570274), and July 23,2010 (ML102090054), Tennessee Valley Authority (TVA) submitted a request for approval of the Watts Bar Nuclear Plant Cyber Security Plan for Watts Bar Nuclear Plant, Units 1 and 2. In this letter, TVA requested that the information contained in Enclosure 2, "Watts Bar Nuclear Plant Cyber Security Plan Implementation Schedule," and Enclosure 3, "Watts Bar Nuclear Plant Cyber Security Plan," of the letter dated July 23, 2010, be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390 because it contains sensitive information.

The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains sensitive information and should be withheld from public disclosure.

Therefore, Enclosure 2 and Enclosure 3 of the letter dated July 23, 2010, marked as "Security-Related Information - Withhold under 10 CFR 2.390," will be withheld from pUblic disclosure pursuant to 10 CFR 2.390 and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the NRC staff may send copies of this information to our consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling sensitive security-related information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, TVA should promptly notify the NRC.

In all review situations, if the NRC makes a determination adverse to the above, TVA will be notified in advance of any public disclosure.
