WITHDRAWAL OF AN AMENDMENT REQUEST FOR APPROVAL OF THE CYBER SECURITY PLAN (TAC NOS. ME2664, ME2665, ME2666, ME2746, AND ME2796)
Gentlemen:
By letters dated November 18, 19, and 23, 2009 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML093410254, ML093270227, ML093340350, and ML093290248), the Carolina Power & Light Company, now doing business as Progress Energy Carolinas, Inc., and the Florida Power Corporation, now doing business as Progress Energy Florida, Inc. (the licensees), applied for license amendments for the Brunswick Steam Electric Plant, Units 1 and 2, the Crystal River 3 Nuclear Generating Plant, the H.B. Robinson Steam Electric Plant, Unit No.2, and the Shearon Harris Nuclear Power Plant, Unit 1 (Facility Operating License Nos. DPR-71, DPR-62, DPR-72, DPR-23, and NPF-63, respectively).
The license amendment requests (LARs) included the Cyber Security Plan, proposed changes to the (Renewed) Facility Operating License, and a proposed Cyber Security Plan Implementation Schedule for each facility. The proposed Cyber Security Plans were submitted in accordance with Title 10 of the Code of Federal Regulations, Section 73.54, "Protection of digital computer and communication systems and networks."

- 2 Subsequently, by letter dated July 8, 2010 (ADAMS Accession No. ML101950042), the licensees superseded the above LARs and requested that the original LARs be withdrawn. The purpose of this withdrawal was to allow the licensees to submit a fleet Cyber Security Plan that conforms to the model Cyber Security Plan contained in Appendix A of Nuclear Energy Institute document NEI 08-09, "Cyber Security Plan for Nuclear Power Reactors," Revision 6, dated April 2010, with one deviation regarding the definition of a Cyber Attack as described in the licensees' letter.
This letter is to advise you that the applications dated November 18, 19, and 23, 2009, are being treated as withdrawn and superseded by the LAR contained in the licensees' July 8, 2010, letter. Notice of Consideration of Issuance of the proposed amendments had not been published in the Federal Register.
