Steve, Yesterday, I sent you a brief e-mail indentifying in draft form the identified insufficiencies in the subject license amendment request. This e-mail is an expanded and more formal transmittal of the information and, as such, includes the information previously sent. Please accept this e-mail in place of the previous one.

Attached please find the requested information, in draft form, that has been developed during the NRCs acceptance review process for the Wolf Creek License Amendment Request concerning the pressure boundary designation for the power operated relief valves and their associated block valves. Please note that the acceptance review is still ongoing. Hence, you will be advised separately of any additional acceptance review issues that may still be identified.

By letter dated April 13, 2010, (Agencywide Documents Access and Management System (ADAMS) Accession Number ML101100479), Wolf Creek Nuclear Operating Corporation submitted a license amendment request for the Wolf Creek Nuclear Generating Station. The proposed amendment would revise the Approved Fire Protection Program to remove the high/low pressure designation from the pressurizer power operated relief valves (PORVs) and their associated block valves. The purpose of this e-mail is to provide the draft results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.

The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that the attached information is necessary to enable the staff to make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment.

In order to make the application complete, the NRC staff requests that Wolf Creek Nuclear Operating Corporation supplement the application with a response that address the items identified in the attachment to this e-mail. This will enable the NRC staff to begin its detailed technical review. A teleconference has been setup to discuss these issues on Thursday, May 13, 2010. The purpose of the teleconference is to identify the omitted or insufficient information, discuss an appropriate course of action, and establish a due date for supplementing the application.

After the teleconference to discuss the draft requested information, I will make any needed changes and will send you an official letter documenting this portion of the acceptance review.
