Application Accepted - LAR re. TSTF-425 Risk-informed Relocation of Surveil Freq Requirements (ME3368-69 for Byron; ME3370-71 for Braidwood)

Pat, By letters dated March 15, 2010, Exelon Generation Company, LLC (the licensee) submitted license amendment requests (LARs) for Braidwood Station, Units 1 and 2, and Byron Station, Unit Nos.1 and 2 (ADAMS Accession Nos. ML100480007 and ML100480008, respectively).

The LARs propose to modify the Braidwood and Byron Technical Specifications (TS) using a risk-informed approach by relocating specific surveillance frequencies to a licensee-controlled program with the implementation of Nuclear Energy Institute 04-10, in accordance with TS Task Force (TSTF) change traveler TSTF-425, Revision 3, with certain deviations/variations. The purpose of this message is to provide the results of the Nuclear Regulatory Commission (NRC) staff's acceptance review of these LARs. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review was also intended to identify whether the applications have any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license must fully describe the changes requested and follow, as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your applications and has concluded that they do provide technical information in sufficient detail to enable the NRC staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendments in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the NRC staff to complete its technical review, you will be advised by separate correspondence.

In accordance with our process as described in LIC-109, "ACCEPTANCE REVIEW PROCEDURES," I am placing a copy of this email in ADAMS as a publicly-available, official agency record.

Sincerely, Marshall David Senior Project Manager (301) 415-1547 E-mail Properties
