Dear Mr. Belcher:

On December 12,2007, the U.S. Nuclear Regulatory Commission (NRC) issued Bulletin 2007 01, "Security Officer Attentiveness" (Agencywide Documents Access and Management System (ADAMS) Accession No. ML073400150).

Nine Mile Point Nuclear Station, LLC (the licensee) provided a response, dated February 11, 2008 (ADAMS Accession No. ML080430474), to Bulletin 2007-01. Once the licensee response was reviewed for Nine Mile Point Nuclear Station, Unit Nos. 1 and 2 (NMP1 and t\\lMP2), the NRC staff identified a need for additional information. To gather that information, the NRC staff issued a Request for Additional Information (RAI) to the licensee on June 30, 2008 (ADAMS Accession No. ML081820069). The licensee provided a response to the RAI on August 1, 2008 (ADAMS Accession No. ML082190063), which included detailed descriptions of the administrative and managerial controls to deter and address inattentiveness and complicity among licensee security personnel at NMP1 and NMP2. Due to the sensitivity of the subject matter, some responses may contain Security-Related Information and may not be publicly available.

The NRC staff has reviewed the submitted information and has concluded that your response to Bulletin 2007-01 and the subsequent RAI is adequate for NMP1 and NMP2. The bases for the NRC's conclusion have been documented in a memorandum, "Security Bulletin 2007-01, Security Officer Attentiveness: Summary Report" (ADAMS Accession No. ML093440311).

Based on this review, your response to the Bulletin 2007-01 is considered closed and no further action is requested of you at this time.
