Dear Sir or Madam:
Entergy Nuclear Operations, Inc, (Entergy) requested an exigent License Amendment to Operating License DPR-64, Docket No. 50-286 for Indian Point Nuclear Generating Unit No. 3 (IP3) in Reference 1. This was supplemented in References 2 and 3 based on discussions with the NRC. The proposed amendment is to allow a one time extension of the 72 hour8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> completion time of Technical Specification (TS) 3.7.5, Condition B, Action B.1 "Restore AFW train to OPERABLE status" by 34 hours3.935185e-4 days <br />0.00944 hours <br />5.621693e-5 weeks <br />1.2937e-5 months <br />. The NRC reviewed these submittals and determined,
NL-10-010 Docket No. 50-286 Page 2 of 2 Reference 4, that there was insufficient justification to use the exigent provisions of 10 CFR 50.91. The NRC requested that Entergy indicate whether the amendment would be withdrawn or whether NRC should continue to process it under the normal public notice provisions of 10 CFR 50.91. Entergy requests that the NRC continue to process the amendment under the normal public notice provisions of 10 CFR 50.91. The note proposed in Reference 1, "(1) A one time extension to 106 hours0.00123 days <br />0.0294 hours <br />1.752645e-4 weeks <br />4.0333e-5 months <br /> during the first 45 days after amendment approval for repairs to AFW pump 32" should be changed to say ""(1) A one time extension to 106 hours0.00123 days <br />0.0294 hours <br />1.752645e-4 weeks <br />4.0333e-5 months <br /> during the first 90 days after amendment approval for repairs to AFW pump 32." The 32 Auxiliary Feedwater Pump passed the most recent on January 9, 2010 but remains in the alert status. The pump is expected to continue to pass the surveillance test every 45 days.
Increasing the period of applicability to 90 days is to assure that the maintenance work on the pump can be integrated with the upcoming Unit 2 refuel outage. The commitments made in References 1 and 2 remain the same.
