Pursuant to 10 CFR 26.717(e), enclosed is the 2009 Annual Fitness For Duty (FFD) Program Performance Data for the above listed plants belonging to Carolina Power & Light Company, now doing business as Progress Energy Carolinas, Inc. (PEC), and Florida Power Corporation, now doing business as Progress Energy Florida, Inc. (PEF). The enclosed report provides FFD Program performance data for personnel subject to the requirements of 10 CFR 26 for the period January 1, 2009 through December 31, 2009.

Violations of the work hour rules were entered into the corrective action program as required by procedure. One deficiency was identified in the annual review related to staffing plans for safety system outages and entered into the corrective action program for tracking and resolution.

One non-waiver fatigue assessment was performed at CR3 during 2009 following a minor vehicle accident. The worker was found not to be fatigued. Violations of the work hour rules occurred in September and October at the beginning of the unit outage. These instances involved transmission personnel and other maintenance personnel. These instances were entered in the corrective action program per the procedure for tracking and resolution. During the annual review, corrective actions were deemed effective since no additional violations occurred during November and December.
