RESPONSE TO CONFIRMATORY ORDER MODIFYING LICENSE (EFFECTIVE IMMEDIATELY) [OFFICE OF INVESTIGATIONS REPORT NO. 4-2007-009], CONDITION 2

Dear Mr. Edington:

On December 22, 2009, NRC Region IV completed an in-office review of the actions you have taken to address Condition 2 in Section V of Confirmatory Order EA-07-162, issued on October 19, 2007. Conditions 1, 3, 4, 5, 6, and 7 were confirmed to be satisfied in prior NRC correspondence, dated February 28, 2008; May 29, 2008; and April 13, 2009.

Condition 2: APS will perform assessments of its independent verification process in the Operations and Maintenance Departments. The assessments will be completed within 12 months of the date of the Confirmatory Order, and applicable actions resulting from the assessment will be tracked to completion. In addition, within this same time period, APS will incorporate in a QA audit plan, a follow-up assessment to ensure the actions to improve the independent verification processes were effective.

In our letter dated April 13, 2009, we advised you that in order to ensure actions taken to improve the independent verification process were effective, we would keep Condition 2 open pending NRC review of future audits. The Region IV staff reviewed the Verification Process Audit Report, 2009-011, Revision 1, that was approved on October 1, 2009. The staff noted that the actions from the Operations and Maintenance self-assessments of the independent verification process were effective in improving the overall performance of Operations, Maintenance and Nuclear Projects verifications.

The Region IV staff concludes that you completed Condition 2 in Section V of Confirmatory Order EA-07-162, issued on October 19, 2007.

All seven Conditions of Confirmatory Order EA-07-162 have been verified complete by the Region IV staff. Any action items generated that are associated with this Confirmatory Order may be subject to future inspections.
