NextEra Energy Point Beach, LLC (NextEra) submitted License Amendment Request (LAR) 261 (Reference I ) on April 7, 2009, pursuant to 10 CFR 50.90. The proposed amendment would increase each unit's licensed core power level from 1540 megawatts thermal (MWt) to 1800 MWt reactor core power, and revise the Technical Specifications to support operation at the increased core thermal power level.

NextEra withdraws the expedited review request submitted via Reference 2. Based on our assessment of resources and risk over the last year, NextEra has decided to move implementation of the Unit 1 Extended Power Uprate (EPU) to the fall 201 I refueling outage.

The Unit 2 EPU implementation plan remains the same. provides the basis for withdrawing the expedited review request and revised schedule for the PBNP EPU. Enclosure 2 provides implementation plans for Regulatory Commitments, Technical Specifications and methodologies, and modifications consistent with the schedule changes above.

This letter contains no new regulatory commitments and no revisions to existing commitments.

The information contained in this letter does not alter the no significant hazards consideration contained in Reference (I) and continues to satisfy the criteria of 10 CFR 51.22 for categorical exclusion from the requirements of an environmental assessment.

ENCLOSURE I NEXTERA ENERGY POINT BEACH, LLC POINT BEACH NUCLEAR PLANT, UNITS I AND 2 LICENSE AMENDMENT REQUEST 261 EXTENDED POWER UPRATE WITHDRAWAL OF EXPEDITED REVIEW REQUEST EXPEDITED REVIEW REQUEST WITHDRAWAL AND REVISED EPU SCHEDULE As noted in Reference (I), the increase in core thermal power was planned to be accomplished following the spring 2010 Unit 1 refueling outage beginning with Cycle 33, and following the spring 201 1 Unit 2 refueling outage beginning with Cycle 32.

After initial review of the License Amendment Request (LAR) 261 (Reference I), and supplemental information (References 2 and 3), the NRC accepted the auxiliary feedwater (AFW) and non-Extended Power Uprate (EPU) reactor protection systemlengineered safety features actuation system (RPSIESFAS) setpoint portions for review (Reference 4).

Acceptance of the balance of the EPU LAR, however, was delayed pending issuance of requests for additional information (RAls) on LAR 241, Alternative Source Term.

Based upon the schedule considerations contained in NRR Office Instruction LIC-112, Power Uprate Process (Reference 5), for review of EPUs, NextEra Energy Point Beach, LLC (NextEra) recognized that the NRC review of the balance of the EPU LAR would move beyond the original spring 2010 refueling outage EPU implementation of Unit 1. As a result, NextEra decided to pursue a mid-fuel cycle EPU implementation on Unit 1.

In order to implement the Unit 1 EPU mid-fuel cycle, certain Technical Specification (TS) changes identified in LAR 261 would require early approval in order to implement the EPU modifications originally planned during the spring 2010 refueling outage on Unit 1. This would allow NextEra to implement the EPU at mid-fuel cycle on Unit I once the NRC review of the balance of the EPU was complete. Accordingly, in Reference (6), NextEra requested review and approval of the TS changes required to support installation of the EPU modifications during the Unit 1 2010 spring refueling outage by February 1, 201 0.

Based on our assessment of resources and risk over the last year, NextEra has decided to move implementation of the Unit 1 EPU to the fall 201 1 refueling outage. The Unit 2 EPU implementation plan remains the same. Thus, by copy of this letter, NextEra withdraws the expedited review request submitted via Reference (6).

During the public meeting between the NRC and NextEra (Reference 7), NextEra discussed the schedule changes for EPU. Based on that discussion, the proposed schedule is provided below.

NextEra will submit marked up TS for the setpoints by February 19, 2010 and requests NRC approval by April 2010. These changes will be implemented on both units within 180 days of NRC approval.

AFW NextEra will submit a letter requesting Commission approval for implementation of proposed AFW license basis changes at current licensed power levels by the end of March 2010. The letter will request Commission approval prior to July 2010. The changes will be implemented for both Point Beach Nuclear Plant units no later than the spring 201 1 Unit 2 refueling outage; however, these changes may be completed by the end of 201 0.

Balance of EPU NextEra will respond to small break loss of coolant accident RAls by February 12, 201 0, and will support an NRC site audit for high energy line break (date to be determined). The balance of RAls is expected by March 2010 per LIC-112 (Reference 5). Based on this schedule, NextEra requests NRC approval for the LAR on the balance of EPU by November 2010 (pending finalization of the Advisory Committee on Reactor Safeguards schedule). These changes will be implemented by spring 201 1 for Unit 2 and by fall 201 1 for Unit I.
