NOTICE OF AVAILABILITY OF THE DRAFT PLANT-SPECIFIC SUPPLEMENT 41 TO THE GENERIC ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF NUCLEAR PLANTS REGARDING COOPER NUCLEAR STATION

Dear Mr. Cochnar:

The U.S. Nuclear Regulatory Commission (NRC) has prepared the enclosed draft plant-specific Supplement 41 to NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, (GEIS) regarding the license renewal of Cooper Nuclear Station (CNS). Appendix D.2 of this document contains the biological assessment (BA) to evaluate whether the proposed renewal of CNS operating licenses for a period of an additional 20 years would have adverse effects on listed species. The proposed action (license renewal) is not a major construction activity.

In a letter dated January 29, 2009, the NRC requested that the U.S. Fish and Wildlife Service provide lists of Federally listed endangered or threatened species, and information on protected, proposed, and candidate species, as well as any designated critical habitat, that may be in the vicinity of CNS and its associated transmission line right of ways. One Federally-listed aquatic species may occur in the Missouri River near CNS: the pallid sturgeon. This BA provides an evaluation of the potential impact of renewing the CNS operating licenses for an additional 20 years of operation on the pallid sturgeon that may occur within the vicinity of the CNS site or along its associated transmission line corridors.

The NRC staff reviewed the status of pallid sturgeon in the Missouri River and the Nebraska Public Power Districts interactions with both State and Federal agencies regarding conservation of pallid sturgeon. These are discussed in the BA. Based on this review, the NRC concludes that the continued operation of CNS for an additional 20 years may affect, but is not likely to adversely affect, the pallid sturgeon.
