OF NOVEMBER 18, 2009, CATEGORY 2 PUBLIC MEETING WITH THE NUCLEAR ENERGY INSTITUTE TO DISCUSS HEALTH PHYSICS ISSUES FOR NEW REACTORS On November 18, 2009, the Nuclear Regulatory Commission (NRC) staff held a teleconference meeting with members of the Nuclear Energy Institute (NEI) to discuss new reactor health physics issues. Enclosure 1 lists the meeting attendees.
A public meeting notice was issued on November 2, 2009, and was posted on the NRC's external (public) web page (Agencywide Document Access Management System (ADAMS)
Accession No. ML093030475). The notice included the meeting agenda, which was also available as a handout at the meeting. The discussions included:
General COLA/DCD Application Status and Lessons Learned Status of Industry Radiation Protection Templates Radiological Aspects of Construction and Pre-Operation Regulatory Updates and Perspectives Miscellaneous Topics of Interest NRC provided status updates of COLA and DCD applications and lessons learned from the review process. Information provided included NRC staff review of the Turkey Point proposed use of deep well injection, the ongoing transition from Bellefonte to Vogtle as the RCOL for AP-1000, AP-1000 shield building load basis, and progress of the EPR and USAPWR design applications. NRC also provided information concerning several generic review focus areas including reactor cavity drain down during refueling (GSI-137), shielding design & dose rate calculations, and DCD departure documentation.
NRC and industry representatives discussed the status of the Radiation Protection Program templates developed by NEI to support COL applications. NEI stated that the final accepted versions of the NEI 07-08A and NEI 08-08A templates were electronically submitted to the Document Control desk on 29 October, 2009.
R. Roach NRC stated that ADAMS document numbers were not yet available, but that as soon as they were available they would be sent to NEI and the ADAMS numbers would be included in the meeting summary along with the ADAMS document numbers for all of the NEI Radiation Protection Templates. Subsequent to the meeting, NRC staff verified that NEI 07-08A and NEI 08-08A are available as ADAMS documents ML093220178 and ML093220530 respectively.
In response to the NEI question asked during the October 21, 2009 meeting about being able to identify the Requests for Additional information (RAIs) related to 10 CFR 20.1406 that have been issued, NRC stated that no reports have been developed across designs for a specific issue or topic. However, RAI reports for each COL are publicly available via the New Reactor section of the NRC website. NRC stated that work is ongoing to develop additional report queries that will support this type of report generation across designs.
NEI presented problem statements on the planned radiological aspects of construction and pre-operation discussion topics. The topics were; 1) Excavation & dredging of soils & sediments, and pumping of surface & groundwater, 2) Exposure of workers from a neighboring operational nuclear plant, 3) Use of radioactive sources NOT covered under the COL. The problem statements were revised by NEI to include the applicable regulations and associated Regulatory Guides. During development of the problem statements NEI identified many interrelated aspects of all topics, and that a collocated Part 50 licensee will have responsibilities prior to, and after, a Part 52 COL is issued. Lengthy discussion of the topics did not result in any final determination of how each topic could best be addressed. NEI reiterated that the purpose of the discussions is to come to a common understanding of the potential issues that may arise during construction and pre-operation, and identify the applicable regulatory basis. NRC mentioned that a regulatory guide is being developed regarding residual radioactivity and may be useful in addressing soil and sediment. NEI and NRC agreed that a Regulatory Issue Summary (RIS) may be the best way to identify Part 50 licensee responsibilities under the existing license regarding new reactor construction. NEI and NRC agreed to review the problem statements and bring additional discussion points to the December meeting.
NRC stated that there was no update on the release of DC/COL-ISG-014, Interim Staff Guidance on Assessing Ground Water Flow and Transport of Accidental Radionuclide Releases (ISG-014), for public comment. NEI stated that they have decided to withhold their comments on ISG-013 until the comments can be submitted in conjunction with the comments for the review of ISG-014.
NRC asked NEI if any new information had been identified by industry that would have any impact on new reactor activities, during the buried piping public meetings in October. NEI stated that industry would be adopting a voluntary initiative concerning buried piping. Details will be provided at a later date. In a related topic, NRC stated that The Commission directed the staff to develop information about how existing and new reactors are addressing buried piping operationally and in design. The memo has not been finalized at this time.

Roach In response to NRC questions from the October 21, 2009 meeting about three topics that were discussed during presentations at the EPRI/NEI Groundwater Workshop and possible effects on NEI 08-08, NEI provided the following information: On the question about an NEI initiative on Accidental Releases from Liquid Tanks; this may have been a miscommunication, it has to do with the ISG-13 and ISG-14 reviews. On the question about plans to revise the groundwater guidelines; EPRI has no near term plans to revise the guidelines. On the question of what appears to be a focus on Carbon-14 during several presentations; a study is planned of C-14 production, form, release, and methods of how to include the dose in effluent reports with a due date in late 2010.
The next meeting is scheduled for December 15, 2009, and the January 2010 meeting is scheduled for January 20, 2010. All upcoming scheduled meetings will be held at the White Flint complex.
