Thank you for your question via telephone on October 26th regarding the Exelon license amendment request (LAR) submitted to the Nuclear Regulatory Commission on August 28, 2009, requesting a one-time extension for the Peach Bottom (PBAPS) Unit 2 containment Type A Integrated Leak Rate Test (ILRT) from 10 to 15 years (Agencywide Documents Access System (ADAMS)
Accession No. ML090430367). My understanding is that you are inquiring as to why the licensee is requesting an extension for 5 years as opposed to a shorter time frame.
To answer you directly, Exelon did not provide an explanation for why the extension request was not made for a time period of less than 5 years. However, in requesting a 5-year extension, Exelon is following the common practice for licensees that request containment Type A ILRT test extensions. For example, in the present LAR for Peach Bottom, Exelon cited similar, previous LARs requesting a 5-year extension that have been approved by the NRC staff:
- Peach Bottom Atomic Power Station, Unit 3 (License Amendment No. 244 issued by NRC letter dated October 4, 2001 - ADAMS Accession No. ML012210108).
- Vermont Yankee Nuclear Power Station (License Amendment No. 227 issued by NRC letter dated August 31, 2005 - ADAMS Accession No. ML052000003).
- Cooper Nuclear Station (License Amendment No. 224 issued by NRC letter dated October 3, 2006 - ADAMS Accession No. ML062540024).
- Nine Mile Point Nuclear Station, Unit 1 (License Amendment No. 202 issued by NRC letter dated March 11, 2009 - ADAMS Accession No. ML090430367).
Exelon provided deterministic and risk-informed evaluations in their LAR purporting to technically justify that the 5-year extension maintains the public health and safety. In addition, in Section 2.1 of the LAR, the licensee states that, A substantial cost savings will be realized by deferring the Type A test for an additional five (5) years. The NRC staffs approach in reviewing the LAR will be to evaluate the licensee's proposed change against the relevant regulatory requirements and the technical adequacy of the proposal. Cost/savings considerations will not factor into the NRC staffs review of the amendment request.
