Dear Mr. Scarpello:
By letter dated September 18, 2009 (ADAMS Accession No. ML092680722), Indiana Michigan Power Company submitted a request for a one-time schedular exemption from the provisions of 10 CFR 26.205(d)(4) for operations and maintenance personnel performing outage activities in support of the restart of the Donald C. Cook Nuclear Plant, Unit 1 (CNP-1).
Nuclear Regulatory Commission (NRC) staff in the Division of Operating Reactor Licensing, as well as in the Health Physics and Human Performance Branch of the Division of Inspection and Regional Support, reviewed the exemption request to determine if there was sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.
The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
The staff has reviewed the exemption request and concluded that it provides technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed exemption in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
