Dear Mr. Scarpello:

This e-mail is in reference to Indian Michigan Power Company's (I&M, the licensee) request for a one-time schedular exemption from the requirements of 10 CFR 26.205(d)(4) dated September 18, 2009 (Agencywide Documents and Access Management System (ADAMS)

Accession No. ML092680722). The proposed exemption would allow the less restrictive working hour limitations during a 60-day period starting on a date to be determined by I&M, consistent with the restart on Unit 1 from the current extended outage. The proposed exemption would apply only to Operations and Maintenance personnel supporting the increased outage activity workload associated with the restart.

The NRC staff in the Operator Licensing and Human Performance has reviewed I&M's submittal and developed draft requests for additional information (RAI). The DRAFT RAIs are as follows:

1. In the exemption request, the phrase "schedular exemption" is used several times.

Please provide further clarification of the phrase "schedular exemption."

2. Please explain how a "one-time schedular exemption from the provisions of 10 CFR 26.205(d)(4)" achieves the intended purpose of the request. Specifically, please provide further clarification as to why an exemption is being requested from the requirements of 10 CFR 26.205(d)(4).

The NRC staff would still like to review the draft RAIs with you in a conference call.
