SUMMARY
OF SEPTEMBER 29, 2009, MEETING WITH EXELON TO DISCUSS PROPOSED LICENSE AMENDMENT REGARDING SECONDARY CONTAINMENT OPERABILITY (TAC NO. MD7261)
On September 29,2009, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Exelon at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss outstanding issues associated with the NRC staff review of a license amendment request for Oyster Creek regarding secondary containment operability. Enclosed is a list of attendees.
Exelon submitted the application for the subject amendment request on November 2, 2007 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML073180397). The request has been supplemented by letters from the licensee dated May 5, July 3, and September 22,2008 (ADAMS Accession Nos. ML081330320, ML081930802, and ML082670773, respectively). On September 11, 2009, the NRC staff sent Exelon two sets of draft request for additional information (RAI) questions (ADAMS Accession Nos. ML092540236 and ML092540545). These questions represent the current outstanding issues the NRC staff has identified with respect to reaching a decision on the proposed amendment.
During the meeting, the licensee discussed the proposed resolution of the RAls. Much of the discussion involved what is assumed and credited in the licensee's analysis supporting the proposed amendment. Exelon's current analysis is based on a fuel decay time of 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> and would allow four specific secondary containment penetrations to be open. The NRC staff noted that many of the concerns that were raised in the draft RAls would likely be eliminated if the analysis was based on a more conservative bounding decay time such that any penetration could be left open. Exelon stated that it would assess the impact of using a bounding decay time and will provide feedback to the NRC staff in a few days regarding this assessment. The NRC staff stated that it would defer any decision regarding issuance of final RAls until after Exelon provided feedback concerning use of a bounding decay time.
Members of the public were not in attendance. Three representatives from the State of New Jersey (NJ), Department of Environmental Protection (DEP) participated via teleconference.
The NJ DEP staff asked several questions which were addressed by the NRC staff and licensee staff.
