SUMMARY
OF AUGUST 19, 2009, MEETING WITH CAROLINA POWER &
LIGHT COMPANY TO DISCUSS POTENTIAL LICENSE CHANGES TO IMPLEMENT MELLA PLUS AT BRUNSWICK, UNITS 1 AND 2.

On August 19, 2009, the Nuclear Regulatory Commission (NRC) staff conducted a Category 1 public meeting with Carolina Power & Light Company (the licensee), now doing business as Progress Energy, at the NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss potential license changes and the licensee's overall plan to implement maximum extended load limit line analysis plus (MELLA Plus) at Brunswick Steam Electric Plant (BSEP), Units 1 and 2. This was not intended as a decision-making meeting. Enclosure 1 contains a list of attendees. The licensee had originally requested a revision to the BSEP, Units 1 and 2 Technical Specifications by letter dated November 12, 2002, to support an expansion of the core flow operating range (i.e., MELLA PIus). Subsequently, the licensee withdrew its license amendment request (LAR) by letter dated August 25, 2005, and stated that it planned to resubmit at a later date. The licensee requested the subject meeting to discuss its intent to resubmit the MELLA Plus LAR.
The licensee presented a MELLA Plus overview, its licensing progress to date, and the licensee's progress toward the LAR. During the meeting, the licensee and the NRC staff focused on the fuel and plant licensing analysis strategy, thermal hydraulic stability solution, and anticipated transient without scram analysis and mitigations. The licensee also stated that the MELLA Plus LAR will be based on the ATRIUM-1 OXM (A1OXM) fuel design, if timing and reviews support the MELLA Plus submittal. Further, the licensee presented its plans for submittal and implementation, if approved, of the fuel design and MELLA Plus LARs.
During the meeting, the NRC staff noted that the licensee plans to submit the A1OXM LAR in spring 2010 and resubmit the MELLA Plus LAR in fall 2010, and that the NRC may still be reviewing the A1OXM LAR by the time the MELLA Plus LAR is submitted. The NRC staff referred to the Office of Nuclear Reactor Regulation Office Instruction, L1C-109, "Acceptance Review Procedures," and advised the licensee that these LARs are considered as linked amendments and that per L1C-109 linked amendment requests will not pass acceptance.
