NEI 99-01, METHODOLOGY FOR DEVELOPMENT OF EMERGENCY ACTION LEVELS, REVISION 5, SECURITY EMERGENCY ACTION LEVELS

Dear Mr. Nelson:

By letter dated July 24, 2009, the Nuclear Energy Institute (NEI) requested a one-time review and endorsement by the U.S. Nuclear Regulatory Commission (NRC) for the use of NEI 99-01, Revision 5 security emergency action levels (EALs) to support implementation of the revised security regulations of Title 10 of the Code of Federal Regulations (10 CFR) 73.55 and 10 CFR 73.56.

The NRC staff issued NRC Bulletin 2005-02 on July 18, 2005, to obtain information from licensees on progress in implementing EP program enhancements related to security events.

The NRC staff later issued Regulatory Issue Summary 2006-12, Endorsement of Nuclear Energy Institute Guidance Enhancements to Emergency Preparedness Programs for Hostile Action, dated July 19, 2006, as an adequate methodology to implement the enhancements discussed in NRC Bulletin 2005-02.

Revision 5 of NEI 99-01 was developed in part, to address the security-related EALs modified by NRC Bulletin 2005-02, Emergency Preparedness and Response Actions for Security-Based Events and to support implementation of NEI 03-12, Template for Security Plan, Training and Qualification Plan, and Safeguards Contingency Plan, that serves to implement the revised security regulations.

The NEI stated that the industry is seeking clear understanding of the regulatory process for revising and implementing Security EALs from NEI 99-01, Revision 5, to support licensees Security Plan implementation of NEI 03-12.

In response to NEIs request, my staff will submit this issue into the EAL frequently asked questions (FAQs) process. The EAL FAQ process is intended to clarify the NRC staffs interpretation of existing EAL guidance issued or endorsed by the NRC, and will not be used to create new regulatory positions or guidance. This will provide interested outside parties an opportunity to share their individual views with NRC staff regarding the appropriate response to questions raised on the interpretation or applicability of emergency preparedness regulatory guidance issued by the NRC, before the NRC issues an official response to such questions.
