Acceptance of License Amendment Request to Provide Consistency in Division 3 Emergency Diesel Generator Start Time Technical Specification Surveillance Requirements (TAC No. ME1691).

Mr. Heintz:

By letter dated June 30, 2009, Perry Nuclear Power Plant (PNPP) submitted a request for an amendment to the technical specifications (TS) for the PNPP. The proposed amendment would revise the acceptance criteria for Technical Specification Surveillance Requirement 3.8.1.7 to make the Division 3 Emergency Diesel Generator (EDG) start time requirement consistent with the time incorporated in the safety analysis for design basis events and with the time specified in the other TS 3.8.1 EDG start time surveillances. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff=s acceptance review of this relief request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review of the proposed alternative and make an independent assessment regarding the acceptability of the proposed request in terms of regulatory requirements and the protection of public health and safety and the environment.
