MILLSTONE POWER STATION, UNIT NOS. 1,2 AND 3 AND INDEPENDENT SPENT FUEL STORAGE INSTALLATION - ACCEPTANCE REVIEW REGARDING PROPOSED CHANGE TO THE MILLSTONE POWER STATION EMERGENCY PLAN (TAC NOS. J00287, ME1396 AND ME1397)

Dear Mr. Heacock:

By letter dated May 28, 2009 (Agencywide Documents Access and Management System Accession No. ML091520618), Dominion Nuclear Connecticut, Inc. (DNC), submitted a proposed change to the Millstone Power Station, Unit Nos. 1,2 and 3 (IVIPS1, MPS2 and MPS3, respectively) and the Independent Spent Fuel Storage Installation (ISFSI) emergency plan. The proposed change would replace the Emergency Medical Team with a licensee first aid team.

DNC has determined, in accordance with Title 10 of the Code of Federal Regulations Section 50.54(q), that the change will decrease the effectiveness of the approved emergency plan and therefore needs prior Nuclear Regulatory Commission (NRC) approval.

The purpose of this letter is to provide the results of the NRC staff's acceptance review of the proposed change. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it provides technical information in sufficient detail for the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed change in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
