OF MAY 26,2009, CATEGORY 1 PRE-APPLICATION MEETING WITH DOMINION TO DISCUSS THE PROPOSED LICENSE AMENDMENT REQUEST REGARDING CHARGING PUMPS AT MILLSTONE POWER STATION, UNIT NO.2

Dear Mr. Heacock:

On May 26,2009, a Category 1 public meeting was held between the Nuclear Regulatory Commission (NRC) staff and representatives of Dominion Nuclear Connecticut, Inc. (DNC) at the NRC Headquarters, 11555 Rockville Pike, Rockville, Maryland. The purpose of the pre application meeting was to discuss a planned license amendment request (LAR) regarding the removal of a charging pump surveillance requirement from the Technical Specifications (TSs) currently in place at the Millstone Power Station, Unit NO.2 (MPS2). A notice for this meeting was issued on May 15, 2009, and is available in the Agencywide Documents Access and Management System (ADAMS) Accession No. ML091340133. A list of attendees is enclosed.

The presentation to the NRC staff included a description of the recent history of the charging pump TSs, including the withdrawal of a 2007 LAR regarding the removal of the same charging pump surveillance requirement. DNC discussed how the charging pumps are credited in the Updated Final Safety Analysis Report (UFSAR) accident analysis and how the accident types can be handled without the use of the charging pumps. DNC discussed removing the charging pump from the UFSAR without prior NRC approval using chapter 10 of the Code of Federal Regulation Section 50.59 (10 CFR 50.59). DNC also discussed their intention to move the charging pump surveillance requirement to the Technical Requirements Manual, using the license amendment process, which they stated would lessen the confusion about the charging pump surveillance requirement.

The NRC staff gave DNC feedback on the presentation. The NRC staff expressed concerns with the accident scenario calculations, in particular the calculations used as the basis for the revision of the UFSAR accident analysis. The NRC staff's concerns were focused on the methodology used to complete the updated calculations. NRC staff cautioned that removing the credit for the charging pumps from the UFSAR may not be able to be done without prior NRC approval. No regulatory decisions were made at the meeting by the NRC.

Several members of the public were present for the meeting via telecon. No attendees chose to complete the Public Meeting Feedback Forms (NRC Form 659), which were available at the meeting.
