SUBJECT:

ENVIRONMENTAL ASSESSMENT AND FINDING OF NO SIGNIFICANT IMPACT RELATED TO THE LICENSE RENEWAL FOR THE OCONEE INDEPENDENT SPENT FUEL STORAGE INSTALLATION (TAC NO. L24184)

Dear Mr. Baxter:

By letter dated January 30, 2008, as supplemented January 30, 2009, Duke Power Company LLC d/b/a Duke Energy Carolinas, LLC (Duke) submitted an application to the Nuclear Regulatory Commission (NRC) to renew its license for the Oconee Nuclear Station Independent Spent Fuel Storage Installation (ISFSI). As part of the application, you submitted an Environmental Report, as required by 10 CFR 72.34. The NRC staff has completed its environmental review for this action. The staff concludes that there are no significant radiological or non-radiological impacts associated with the proposed action, and that issuance of a renewal of the license for the interim storage of spent nuclear fuel at the Oconee ISFSI will have no significant impact on the quality of the human environment. A Notice of Issuance of Environmental Assessment (EA) and Finding of No Significant Impact, and the NRC staffs EA related to the continued operation of the Oconee ISFSI are enclosed for your information. The Notice has been forwarded to the Office of the Federal Register for publication.

Our decision on your license application will be addressed in future correspondence, which will include the staffs safety evaluation report. If you have any questions regarding this action, please contact me at (301) 492-3325.
