NRC, "License Amendment Request to Modify Clinton Power Station Facility Operating License in Support of Bulk Isotope Generation Project,"
dated April 8, 2009 In the referenced letter, Exelon Generation Company, LLC (EGC) proposed an amendment to Facility Operating License No. NPF-62 for Clinton Power Station (CPS),
Unit 1. Specifically, EGC proposed changes to the CPS License Conditions 1.J and 2.B.(7) as part of a pilot program to irradiate Cobalt (Co)-59 targets to produce Co-60. In addition to the proposed License Condition changes, EGC also proposed a change to Appendix A, Technical Specifications (TS), of the CPS Facility Operating License. This proposed change would have modified TS 4.2.1, "Fuel Assemblies," to describe the Lead Test Assemblies (LTA) being used in the CPS core as part of this pilot program.
Through recent discussions with the NRC, EGC understands that the NRC staff has concluded that use of the LTA process, as described in the referenced amendment request, is not acceptable. Thus, the referenced amendment request did not contain the necessary information to allow the NRC staff to make an independent assessment regarding the acceptability of the proposed license amendment. Based on the input provided by the NRC and further review, EGC has decided to withdraw the referenced amendment request.
EGC and NRC had several discussions and a presubmittal meeting concerning the proposed license amendment, including the proposed use of the LTA process. The NRC subsequently communicated concerns with the use of the LTA process during its acceptance review of the referenced amendment request. While EGC understands the NRC staff's current position, this issue will be entered into the EGC corrective action program to look for opportunities to have reached this conclusion earlier in the presubmittal interactions.
