SHEARON HARRIS NUCLEAR POWER PLANT, UNIT 1 -ACCEPTANCE REVIEW REGARDING AMENDMENT TO ADOPT TECHNICAL SPECIFICATIONS TASK FORCE (TSTF) STANDARD TECHNICAL SPECIFICATIONS CHANGE TRAVELER, TSTF 447, "ELIMINATION OF HYDROGEN RECOMBINERS AND CHANGE TO HYDROGEN AND OXYGEN MONITORS" (TAC NO. ME0728)

Dear Mr. Burton:

By letter dated February 26, 2009 (Agencywide Documents Access and Management System Accession No. ML090720584), Carolina Power & Light Company, now doing business as Progress Energy Carolinas, Inc. (PEC), submitted a proposed amendment for the Shearon Harris Nuclear Power Plant, Unit 1 (HNP). The proposed amendment would delete the Technical Specifications (TS) requirements related to hydrogen recombiners and hydrogen monitors. The proposed TS changes support implementation of the revisions to Title 10 of the Code of Federal Regulations (10 CFR) Section 50.44, "Standards for Combustible Gas Control System in Light-Water-Cooled Power Reactors," which became effective on October 16,2003.

These changes are consistent with Revision 1 of the U.S. Nuclear Regulatory Commission (NRC)-approved Technical Specifications Task Force (TSTF) Standard Technical Specifications Change Traveler, TSTF-447, "Elimination of Hydrogen Recombiners and Change to Hydrogen and Oxygen Monitors." The availability of this TS improvement was announced in the Federal Register on September 25, 2003 (68 FR 55416).

Consistent with 10 CFR 50.90, an amendment to the license (including the TS) must fully describe the changes requested. and follow, as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required.

This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The purpose of this letter is to provide the final results of the NRC staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed change. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

- 2 The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. This letter is an official follow up to similar information that was discussed with Kara Stacy of your staff during a telephone conversation on March 12, 2009. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
