MD9649)

Dear Mr. Hamilton:

By letter dated September 17, 2008, you applied for an amendment to the McGuire Nuclear Station Operating License No. NPF-9. The proposed change would have supported contingent application of a structural weld overlay to the reactor vessel hot-leg nozzle-to-safe end weld(s) at McGuire Unit1. The examination of these welds was successfully completed on October 12, 2008, and the welds did not require any repair. Subsequently, by letter dated October 24, 2008, you withdrew the amendment request.

The purpose of this letter is to advise that the above-cited application is being treated as withdrawn. Notice of Consideration of Issuance of the proposed amendment had not been i

published in the Federal Register.
