Dear Members of the TSTF:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your February 18, 2009, letter requesting a fee exemption under 10 CFR 170.11(a)(1)(iii) for all fees associated with the NRCs review of TSTF-513, Revise [Pressurized Water Reactors] PWR Operability Requirements and Actions for [Reactor Coolant System] RCS Leakage Instrumentation, and TSTF-514, Revise [Boiling Water Reactors] BWR Operability Requirements and Actions for RCS Leakage Instrumentation. Your request meets the fee exemption criteria; therefore, I have granted your request, as explained below.

Your fee exemption request states that TSTF-513 and TSTF-514 (hereinafter referred to as Travelers) are a means for exchanging information for the purpose of supporting the NRCs generic regulatory improvements related to the resolution of containment atmosphere gaseous radioactivity monitor operability. The NRC staff has reviewed your submittals and concluded that these Travelers address the issue of operability requirements for leakage detection by gaseous radiation monitors, as described in Regulatory Issues Summary (RIS) 2009-2, Use of Containment Atmosphere Gaseous Radioactivity Monitors for Reactor Coolant System Leakage Detection Equipment at Nuclear Power Reactors, dated January 29, 2009. Upon approval, the NRC plans to use the Travelers as part of the guidance on NRCs exercise of enforcement discretion involving inoperable containment atmosphere gaseous radioactivity monitoring systems. Hence, I am able to grant you a fee exemption under the provisions of 10 CFR 170.11(a)(1)(iii).
