Jeff, By letter dated March 5, 2009 (ADAMS Accession No. ML090790206), PSEG Nuclear LLC submitted relief request V-07 to extend the inservice testing (IST) intervals for certain Class 2 and 3 pressure relief valves for Salem Nuclear Generating Station, Unit No. 2. The purpose of this e-mail is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Section 50.55a of Title 10 of the Code of Federal Regulations (10 CFR), requires, in part, that IST of certain American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code (Code) Class 1, 2, and 3 pumps and valves be performed in accordance with the applicable edition of the ASME Code for Operation and Maintenance of Nuclear Power Plants (ASME OM Code) and applicable addenda, except where alternatives have been authorized or relief granted by the NRC pursuant to paragraphs (a)(3)(i), (a)(3)(ii), or (f)(6)(i) of 10 CFR 50.55a. In proposing alternatives or requesting relief, the licensee must demonstrate that: (1) the proposed alternatives provide an acceptable level of quality and safety; (2) compliance would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety; or (3) conformance is impractical for the facility.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed relief request in terms of the applicable regulatory requirements. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
