NORTH ANNA POWER STATION, UNIT NOS. 1 AND 2 - WITHDRAWAL OF REQUESTED LICENSING ACTION RE: LICENSE AMENDMENT REQUEST FOR TECHNICAL SPECIFICATION (TS) 3.7.12 - EMERGENCY CORE COOLING SYSTEM (ECCS) PUMP ROOM EXHAUST AIR CLEANUP SYSTEM (PREACS) SUBMITTED TO NRC FOR ACCEPTANCE REVIEW (TAC NOS. ME0404 AND ME0405)
Dear Mr. Christian:
By letter dated January 15, 2009, Virginia Electric and Power Company (Dominion, the licensee) submitted a license amendment request for North Anna Power Station, Unit Nos. 1 and 2 (North Anna). The proposed amendment request would add new conditions B and C with associated action statements and completion times to TS 3.7.12, specifically addressing the filtration function of the ECCS PREACS. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff=s acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.
The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license (including the TSs) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.
On February 19, 2009, Mr. Dave Sommers of your staff informed the NRC staff during a telephone conference that the amendments are no longer requested at this time. Therefore, your proposed change is considered to be withdrawn. NRC staff activities on the review have ceased and the associated Technical Assignment Control number has been closed. If this information is not correct, please notify the NRC staff of your intended actions within 10 days of receipt of this letter.
The NRC staff notes that its review to date has identified that your application did not provide the following technical information in sufficient detail to enable the staff to complete its detailed review. Therefore, if you decide to re-submit the request, it must address the following concerns:
The licensee makes repeated reference to Updated Final Safety Analysis Report (UFSAR) Figure 15.4-110. This figure is not included with the application. Figure 15.4-110 is currently listed as deleted in the North Anna UFSAR, Revision 44.
The current completion time for one train of ECCS PREACS inoperable is 7 days. The proposed completion time is 60 days if one train (or 30 days if two trains) of ECCS PREACS is inoperable due to filtration capability. The licensee justified the completion times using, among other factors, the low probability of a design-basis accident during the completion time. The licensee did not provide sufficient deterministic justification for the increased completion time. The licensee did not provide any regulatory bases for the increased Completion Times.
Given that 60 days is not used as a completion time for any TS-required action in NUREG-1431 or the TSs for North Anna, the proposed completion time does not appear to be in agreement with the approved guidance of NUREG-1431, or any applicable precedent in the licensee's TSs.
The new action is dependent on specific maximum values of ECCS leakage. The licensee did not provide any description of the surveillance requirements that will assure ECCS does not exceed leakage assumed for the new action.
