Thanks Lynnea By letter dated April 22, 2008, the Omaha Public Power District submitted a license amendment request for the Fort Calhoun Station, Unit 1 for "Clarification of Technical Specification (TS) 2.7(2)j Regarding Emergency Dieses Generators Allowed Outage Time." The Nuclear Regulatory Commission staff has reviewed the information the licensee provided that supports the proposed TS changes. On February 11, 2009, the NRC staff had a conference call with your staff. As a result of that call, the NRC staff determined that additional information is needed to complete its review.

The NRC staff believes that the TS still needs to be refined. The NRC staff believes that removing "and" in the first sentence and starting a new sentence with "In addition to" will make the TS clearer. In system logic space, an "AND" gate infers that both conditions must be met.

Therefore, if entering a new month the condition has not been met, one might interpret this as meaning 7 more days are allowed. Although the licensee clearly does not intend this logic, it could be interpreted this way by a person with this mindset.

The SE will clearly delineate that the seven consecutive days in a calendar month should not be misconstrued to imply 14 consecutive days in two months (i.e. 7 days at the end of one calendar month followed by 7 days at the beginning of the following month which would seem to satisfy "7 consecutive days in each calendar month.)

It is also understood that the licensee will clarify TS bases to note the clarification in the SE.
