Dear Dr. Richards:

The U.S. Nuclear Regulatory Commission (NRC) is continuing the review of your application for renewal of Facility Operating License No. TR-5 for the National Institute of Standards and Technology test reactor dated April 9, 2004, as supplemented by letters dated October 2, 2006; May 30, and August 14, 2007; and September 16, October 21, and December 8, 2008. During NRC staff review it was determined that additional information and clarification contained in the enclosure is required to continue the review. Please provide a response to the enclosed request for additional information no later than March 9, 2009. In accordance with Title 10 of the Code of Federal Regulations Part 50.30(b), your response must be executed in a signed original under oath or affirmation. Following receipt of your response, the NRC staff will continue the review of your application.

OFFICE OF NUCLEAR REACTOR REGULATION REQUEST FOR ADDITIONAL INFORMATION NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY NATIONAL BUREAU OF STANDARDS REACTOR DOCKET NO. 50-184 Title 10 of the Code of Federal Regulations (10 CFR) 55.59(a)(1) requires, and American National Standards Institute/American Nuclear Society (ANSI/ANS) standard 15.4-2007 recommends, that the duration of a requalification program not exceed 24 months. The NBSR requalification plan states; The program shall be administered over a normal period of 24 months, to be followed by successive 24 month periods, with no period to exceed 30 months.

The next sentence of the requalification plan gives the justification for the extra time; The maximum period is to provide administrative flexibility and is not to be used to reduce frequency; the 24 month period shall be maintained over the long term.

If it is your intent to request a waiver of the requirements of 10 CFR 55.59(a)(1), please state so and provide justification for a waiver. If it is not your intent to request a waiver of the requirements of 10 CFR 55.59(a)(1), please modify paragraph 3.1 Administration to comply with the requirements of 10 CFR 55.59(a)(1).
