We are continuing our review of your application for renewal of Facility Operating License No.

TR-5 for the National Institute of Standards and Technology test reactor dated April 9, 2004, as supplemented on October 2, 2006; May 30 and August 14, 2007; and September 16 and October 21, 2008. During our review, questions have arisen for which we require additional information and clarification. Please provide responses to the enclosed requests for additional information no later than 30 days from the date of this letter. REQUEST FOR ADDITIONAL INFORMATION NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY NATIONAL BUREAU OF STANDARDS REACTOR DOCKET NO. 50-184 The following requests for additional information (RAIs) are based on a comparison of the National Institute of Standards and Technology (NIST) National Bureau of Standards Reactor (NBSR) emergency plan, dated September 2008, with the guidance contained in the American National Standards Institute standard ANSI/ANS-15.16, Emergency Planning for Research Reactors, dated May 2000, and NUREG-0849, Standard Review Plan for the Review and Evaluation of Emergency Plans for Research and Test Reactors, dated October 1983.

1. Section 3.1 Identify by title, with a line of succession, the position in the emergency response organization in charge of radiological assessments including the responsibilities and authority for onsite and offsite dose assessments and recommended protective actions.
2. Section 3.2 Section 3.2 references the Maryland Air and Radiation Management Division.

Update this reference to reflect that the current name of the agency is the Maryland Air and Radiation Management Administration.

3. Section 3.2 Provide a copy of the written agreement between NIST and National Naval Medical Center (NNMC) that is up-to-date and accurately reflects current information and organization titles (i.e., NIST vs. NBS).
4. Section 3.2 Section 3.2 states, Local medical facilities identified in emergency procedures also have the resources for treating contaminated injured personnel. What are these facilities?

Are there arrangements and agreements, confirmed in writing, in place with these facilities? If yes, provide the letters of agreement.

5. Section 5.0 Consider using the Emergency Action Level guidance provided in NRC Information Notice 97-34, Fire within the reactor facility not extinguished within 15 minutes.
6. Section 7.1(a) Initial notification of the NRC must be made to the NRC Headquarters Operations Center at 301-816-5100 (main), or 301-951-0550 (backup #1), or 301-415-0550 (backup #2), or 301-415-0553 (backup #3). Revise Section 7.1(a) accordingly.
7. Section 7.1(b) Review NRC Information Notice 92-79, Non-power Reactor Emergency Event Response, and revise the timeframes for notification of the NRC for emergency class declarations to specify shorter timeframes, i.e., approximately one hour. Alternately, provide justification that the timeframes currently specified in the NBSR emergency plan are adequate for all emergency class declarations.
