Jeff, By letter dated December 31, 2008 (ADAMS Accession No. ML090130527), PSEG Nuclear LLC submitted relief requests for the fourth 10-year inservice testing (IST) interval for the Salem Nuclear Generating Station, Unit Nos. 1 and 2. The purpose of this e-mail is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.

The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Section 50.55a of Title 10 of the Code of Federal Regulations (10 CFR), requires that IST of certain American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code (Code) Class 1, 2, and 3 pumps and valves be performed at 120-month (10-year) IST program intervals in accordance with the specified ASME Code and applicable addenda incorporated by reference in the regulations, except where alternatives have been authorized or relief has been requested by the licensee and granted by the NRC pursuant to paragraphs (a)(3)(i), (a)(3)(ii), or (f)(6)(i) of 10 CFR 50.55a.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed relief requests in terms of the applicable regulatory requirements. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
