Dear Mr. Butler:
I am responding to the petition for rulemaking (PRM) dated February 6, 2002, that Anthony R.
Pietrangelo, then Director of Engineering, Nuclear Generation Division at the Nuclear Energy Institute, submitted to the U.S. Nuclear Regulatory Commission (NRC). The petition was docketed as PRM-50-75 and requested that the NRC amend its regulations at Title 10 of the Code of Federal Regulations (10 CFR) Section 50.46, Acceptance Criteria for Emergency Core Cooling Systems for Light-Water Nuclear Power Reactors, 10 CFR Part 50 Appendix A, General Design Criteria for Nuclear Power Plants and 10 CFR Part 50, Appendix K, ECCS Evaluation Models to allow the use of an alternative to the currently required double-ended rupture of the largest pipe in the reactor coolant system in emergency core cooling system (ECCS) evaluation models.
The NRC published the notice of receipt of the petition in the Federal Register on April 8, 2002, (67 FR 16654). The comment period closed on June 24, 2002. The agency received eighteen comment letters.
The NRC has determined that the issues raised in PRM-50-75 are appropriate for consideration and, in fact, the agency is considering them in the ongoing Risk-Informed Redefinition of Large Break Loss-of-Coolant Accident (LOCA) ECCS Requirements rulemaking. This rulemaking proposes revisions to the NRC regulations in 10 CFR Part 50 that address licensing of production and utilization facilities in which the issues raised by PRM-50-75 will be resolved.
Substantive comments received on PRM-50-75 in response to the April 8, 2002, notice of receipt will be addressed as part of the Risk-Informed Redefinition of Large Break LOCA ECCS Requirements rulemaking.
The NRC is transmitting the enclosed Federal Register notice regarding PRM-50-75 that is being transmitted to the Office of the Federal Register for publication.
You can monitor further NRC action on the issues raised by the petition on the Risk-Informed Redefinition of Large Break LOCA ECCS Requirements rulemaking at the Federal rulemaking portal, http://www.regulations.gov, by searching on rulemaking docket ID: NRC-2002-0018 and docket ID: NRC-2008-0332. The NRC also tracks all rulemaking actions in the NUREG-0936 NRC Regulatory Agenda: Semiannual Report (NUREG-0936).
As indicated above, the Commission has concluded its evaluation of PRM-50-75 and included it for consideration as part of the rulemaking on Risk-Informed Redefinition of Large Break LOCA ECCS Requirements. Therefore, the NRC considers PRM-50-75 closed.
