CLINTON POWER STATION, UNIT NO. 1 - LETTER DOCUMENTING THE TELE-CONFERENCE REGARDING LICENSE AMENDMENT TO REVISE LOCAL POWER RANGE MONITOR CALIBRATION FREQUENCY (TAC NO. MD3795)

Dear Mr. Pardee:

By letter to the Nuclear Regulatory Commission (NRC) dated December 12, 2008 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML063470222), as supplemented by letter dated May 16, 2008 (ADAMS Accession No. ML081400237), AmerGen Energy Company, LLC submitted a license amendment request (LAR) to revise the local power range monitor (LPRM) calibration frequency for Clinton Power Station, Unit No. 1 (CPS).

Your May 16, 2008, supplement to your December 12, 2006, LAR provides a technical basis to achieve the requested calibration interval extension by demonstrating that doubling the relevant safety limit minimum critical power ratio uncertainty parameter has a negligible effect on the licensed safety limit minimum critical power ratio (SLMCPR). In light of the cycle-specific nature of the SLMCPR, the NRC staff finds that this parameter must be doubled for all SLMCPR evaluations performed while operating with the LPRM calibration interval extended beyond the current Technical Specification (TS) allowable value of 1250 megawatt days per ton (MWD/T).

The NRC staff finds that doubling this parameter for SLMCPR evaluations will provide reasonable assurance that the predictive capability of the core monitoring system is adequately reflected in the safety limit analysis.

On June 19, 2008, a tele-conference was held between the licensee staff and the NRC staff to discuss the supplement dated May 16, 2008. During the conference call, the licensee agreed to revise the Updated Final Safety Analysis Report to state that, when operating with an LPRM calibration interval in excess of 1250 MWD/T, the SLMCPR, as evaluated using uncertainties contained in Licensing Topical Report NEDC 32694P-A, Power Distribution Uncertainties for Safety Limit Minimum Critical Power Ratio Evaluations, shall use an LPRM update uncertainty parameter that is double the value contained in NEDC 32694P-A.

Pardee Since the NRC staff will use this information as part of the basis for its regulatory decision about the acceptability of the license amendment application, the information must be submitted under oath or affirmation from the licensee. The NRC staff requests that you provide this information to us in this manner, preferably in the form of a regulatory commitment, by no later than 15 days from the date of this letter. The NRC staff considers that timely responses to this request will help ensure sufficient time is available for staff review and will contribute toward the NRC=s goal of efficient and effective use of staff resources.
