LIST OF FOLLOW-UP QUESTIONS FOR THE TELEPHONE CONFERENCE CALL FOR BEAVER VALLEY POWER STATION, UNITS 1 AND 2 LICENSE RENEWAL APPLICATION May 20, 2008 In this telephone conference call, the U.S. Nuclear Regulatory Commission (the NRC or staff) and representatives from FirstEnergy Nuclear Operating Company (FENOC) discussed follow-up questions for the Request for Additional Information (RAI) ENV 3.0-1 for replacement activities of the Beaver Valley Power Station (BVPS) Unit 2 steam generators (SG). The RAI ENV 3.0-1 response dated April 25, 2008 on barge slip dredging were discussed. The following questions were posed to the applicant. These responses have been formally submitted by FENOC as supplemental responses to original RAI ENV 3.0-1, and have subsequently been docketed under oath and affirmation.

1) How often is "maintenance dredging" of the barge slip performed?

Response - There is no regular maintenance dredging and it only occurs as needed, such as the barge transportation of new steam generators.

2) USACE Permit No. 200100242, which covers maintenance dredging of the barge slip until 2011, states "The issuance of this permit does not relieve you of the responsibility to obtain any other required state, local, or Federal authorizations." In addition to the encroachment permit required by the Pennsylvania Department of Environmental Protection, what other permits, if any, are required for dredging of the barge slip?

Response - USACE Permit No. 200100242 is the only permit required for dredging of the barge slip.

3) Did FENOC have to file an environmental assessment with the PADEP to get their encroachment permit? Why or why not? If yes - could we get a copy of that EA?

Response - In the 2005 application for modification of Permit No. 200100242, FENOC engaged in a consultation with the USACE, the Pennsylvania Department of Environmental Protection (PADEP), and the Pennsylvania Fish and Boat Commission (FBC) regarding the environmental impacts of modifying the permitted dredging area. These consultations included mud sampling, an analysis of endangered species impacted by the dredging activities, and precautionary actions such as the prohibition of dredging during the spawning season for threatened and endangered aquatic species. There was no environmental assessment filed with the PADEP.

4) Did USACE Permit No. 200100242 cover dredging in the New Cumberland Pool associated with the 2006 steam generator replacement project?

Response - Yes, US Army Cops of Engineers (USACE) Permit No. 200100242, issued April 10, 2001, expiring April 10, 2011, was the single permit which covered barge slip dredging during the 2006 Unit 1 SG replacement. This permit was modified to allow FENOC to dredge an additional 50 feet beyond its original permitted dredging area to allow the Unit 1 SG transportation barge to be sunk in the Ohio River adjacent to the BVPS barge slip.

4a) If not, was an additional/separate permit required for the steam generator replacement project dredging? Was an environmental assessment required for that permit, or any other permits applicable for the dredging?

N/A 4b) If so, would dredging for the future steam generator replacement project be performed under the existing USACE Permit No. 200100242? Would an extension or renewal of this permit be required to cover the steam generator replacement project?

Response - US Army Cops of Engineers (USACE) Permit No. 200100242, issued April 10, 2001, expiring April 10, 2011, or a modification thereof would be the permit required for similar dredging activities associated with the Unit 2 SG replacement.

5) Was the Fish and Wildlife Service Pennsylvania field office contacted regarding the 2006 steam generator project? (Specifically in regard to the impact of dredging on threatened or endangered freshwater mussels?)

Response - Other agencies were contacted. In the 2005 application for modification of Permit No. 200100242, FENOC engaged in a consultation with the USACE, the Pennsylvania Department of Environmental Protection (PADEP), and the Pennsylvania Fish and Boat Commission (FBC) regarding the environmental impacts of modifying the permitted dredging area. These consultations included mud sampling, an analysis of endangered species impacted by the dredging activities, and precautionary actions such as the prohibition of dredging during the spawning season for threatened and endangered aquatic species. Per the staffs request FENOC has agreed to submit copies of letters, photos, encroachment area drawings and other related correspondence associated with the consultation of these agencies.

6) Where is the location of the temporary construction set down areas, and the Unit 2 permanent SG storage buildings?

Response - The used Unit 2 SG would be permanently stored on-site in a new facility adjacent to the existing used Unit 1 SG storage facility southwest of the BVPS switchyard. Also the planned temporary set down area for Unit 2 SG replacement is the Shippingport Atomic Power Station field, which is the acres of paved parking lots east of the Unit 2 cooling tower.
